2012年是党的十八大召开，实施“十二五”规划承上启下的重要之年，也是全县公安工作承前启后、奋发进取的关键之年。于都县公安局法制室以贯彻落实全局公安工作的总体要求：以 “推动科学发展、建设幸福于都”，深入推进“三项重点工作”和公安“三项建设”，大力实施“五大警务”（即实施民意警务、合成警务、创新警务、信息警务、规范警务），着力提升“五个能力”（即提升公安机关的社会服务力、治安驾驭力、发展内驱力、核心战斗力、队伍凝聚力），为指导思想，团结拼搏，扎实工作，较好地完成了今年全年的各项执法任务。
一、推进执法规范化建设情况
（一）继续全面实行网上执法办案情况。
我局认真总结往年网上执法办案的成功经验，即我局以信息化为手段，以民警培训为重点，以硬性考核为突破，以制度为保障，建立了“信息网上走，案件网上办，执法网上管”的执法办案和执法监督新模式。目前现发现批刑事、行政案件已全部实现了通过案事件信息管理系统网络流转审核审批，法律文书通过系统生成和打印，突出“早、实、严、勤、新”，切实提高了执法办案和执法监督的信息化水平，实现了适时、高效、全程的监督。全年通过警务平台共审核审批刑事案件298起542人，行政案件258起621人。刑事案件、行政案件证据上传率达95%以上。
（二）按期完成执法办案场所功能分区建设。
自2011年开展执法办案场所功能分区改造任务以来，我局按照上级公安机关要求，紧紧围绕“功能完善、设施齐全、突出实用”的建设要求，结合实际，强化措施，按期完成执法办案场所功能分区建设。首先，提高认识，强化责任。县局成立工作领导小组，由局长亲自任组长，分管法制、警务保障的局领导为副组长，成员有法制、督察、后勤相关人员。做到一把手亲自抓，分管领导具体抓，挂点领导协助抓。通过不定期召开会议，听取汇报，协调建设中遇到的问题，保障分区建设工作有序进行。其次，因地制宜，精心规划。根据自身实际情况，我局本着安全、实用、规范、节约的原则，采取多方认证，提出了改造规划，在规划设计上因我局派出所基本上建设于上世纪九十年代，各所建设模式不同，给建设带来较大难度，但我们做到“求大同，存小异”。同时自筹资金，根据方案要求，按计划、有步骤、分批次的开展执法办案场所改造工作。最后，措施得力，如期完工。我局执法办案场所功能分区建设应建数量为27个（其中县局办案中心1个，交警1个，驻外刑侦中队1个，派出所共24个），数量多，要求高。至2012年7月，我局仅完成工作任务3个，与上级要求相差甚远，为此在8月初市局组织召开的执法办案场所推进会上，我局还作了表态性发言。时间紧、任务重，我局及时调整方案，提出切实可行意见，抢抓工程进度，紧凑安排工作，我局组织相关人员经常深入到各单位施工地点指导施工，对施工过程进行监督，同时就施工方在建设中碰到的问题，与施工方沟通，商讨解决方案。由于我局组织严密，措施得力，确保了在11月前完成执法办案场所改造工作任务。
（三）积极准备和组织中级执法资格等级考试情况。
按照省厅、市局统一部署，在12月2日举行的中级级执法资格考试工作中，由法制室具体组织，政治处、督察大队等单位为考试工作提供了全面的服务，为全局269名参考民警顺利通过考试奠定了基础。考试前，积极动员广大民警参加考试，我局报考人数达269人，参考率超50%，报考人数居全市第一。因本次考试我局被统一安排在瑞金市参考，由于参考人数多，县局特别制定后勤保障方案，调集3辆客运车辆，负责接送往返的参考民警，确保每位民警准时准点应考。考试时，广大民警着装规范，严格遵守考场纪律，服从监考指挥，答题认真细致，体现出了于都公安民警严明的纪律作风和超强的业务素质，得到了巡考组的一致好评。由于组织得力，参考民警准备充分，此次中级级执法资格考试圆满成功。
（四）开展突出执法问题整改活动情况。
为深入推进全市公安机关执法规范化建设，进一步规范执法行为，解决突出执法问题，全面提升公安机关的执法水平和执法公信力，于2012年4月-9月，在全局范围内深入开展整改突出执法问题专项活动。紧紧围绕执法规范化建设要求，深入查找公安机关在执法方面存在的突出问题，剖析产生原因，研究和出台整改突出执法问题的相关制度和措施。充分发挥执法质量考评、行政复议、信访案件办理、优/劣质案件评选等手段的作用，通过深入剖析典型案例，开展警示教育，切实整治执法过程中粗放执法、随意执法、简单执法等突出问题，提升执法水平，防止因执法不当印发涉法信访或群体性事件，促进理性、平和、文明、规范执法。
（五）开展旁听庭审的情况和效果。
为规范执法行为，促进执法公正，增强民警执法的程序意识、证据意识、时效意识、诉讼意识，提高我局整体执法质量和执法水平，实现执法意识领先，执法科技领先，执法水平领先的目标，全年县局共组织参加了4次庭审旁听，让民警及时总结办案经验，接受执法教育。
（六）开展“另案处理”刑事案件专项检查。
为深入贯彻落实最高人民检察院、公安部《关于开展“另案处理”案件专项检查活动工作方案》的有关要求，进一步规范刑事执法活动、提高执法公信力，结合我县工作实际，从5月至10月，对2011年度全县检察机关受理的公安机关提请逮捕、移送审查起诉案件中涉及“另案处理”的刑事案件进行专项检查。
二、制度建设及培训情况
（一）邀请高校教授至县局开展专题讲座。
新《刑事诉讼法》将于2013年1月1日起施行，这是刑事诉讼法颁布实施后的第二次大修，为了积极适应修订后刑事诉讼法对公安执法工作提出的新要求，做好该法实施前的准备工作，确保该法在公安执法中得到全面贯彻落实，县局领导研究决定，邀请江西省刑事诉讼法学科带头人之一，专门从事刑事诉讼法的教学与研究工作，江西司法警官学院警察系副主任——
（二）积极开展审讯系统平台操作培训。
为贯彻落实公安部关于推进执法规范化建设、执行新修改的刑事诉讼法的要求，加强执法办案安全防范工作部署的要求，进一步规范审讯工作，提高办案效率和办案质量，我局专门组织各执法办案单位民警参加审讯系统平台操作培训会。会上，副局长曾强强调：审讯工作同步录音录像对我们审讯工作提出了更高的要求，它可实现审讯讯问及询问过程的有效监督和管理，保证办案、取证过程的真实性和有效性。要求大家认真地学习，尽快掌握这套操作系统，并做为本单位的小教员，负责本单位其他人员的培训。之后，安装公司的培训老师就如何掌握该套系统的运用进行了授课，各民警认真听课并就有关问题进行当场提问。会后还组织民警到办案区进行现场指导。
三、劳教及复议诉讼案件办理情况。
（一）劳教案件办理情况。
全年，我局已经办理劳教审批案件4起11人。其中所外执行10人，正在申报所外执行1人。劳教期限为1年的共8人，1年3个月的共1人，1年6个月的2人，未举行公开聆询。
（二）复议案件办理情况。
全年，受理复议案件1件，原告撤回复议申请；受理诉讼案件2件，1件由法院判决维持，1件驳回起诉；无国家赔偿案件。
四、执法监督工作情况。
（一）认真开展2012年度执法质量考评工作。
按照《江西省公安机关执法质量考核评议实施办法》的考评要求，全面抓好执法考评工作。每次考评的成绩、问题及时在全局进行通报，由县局执法考评组对所有执法情况进行考评。全年共检查29个办案单位，考评行政案件、刑事案件共计270件，基本保证了办案质量。
（二）积极开展十大优劣质案件评选工作。
我局于2011年12月底组织开展了全县公安机关十大优质案件和十大劣质案件评选工作。经认真评选，确定了2011年度全县公安机关十大优质案件和十大劣质案件。此次评选优、劣质案件，评审人员认真细致审阅案卷，充分讨论，评选出了“十大优、劣质案件”。通过从评选出的优、劣质案件中，我们从中看到在办理何种案件中，只要我们办案单位重视，办案人员认真细致，具有良好责任意识，有较强的证据意识、程序意识，那我们就能办成漂亮的案件，而如果缺乏应有的工作责任心，哪怕是一起简单的案件，也就会办成劣质案件。同时也使各办案单位认识到牢固树立抓执法的理念，从而不断提高公安执法质量和执法水平。
（三）办理信访工作情况。
今年县局为信访工作增加配备1名民警，并在县局一楼大厅重新装修、专门设立信访接待室，确保每天有值班领导带班，接待上访人员。不定期清理、查处涉法涉诉信访案件，排查不稳定因素，在重大节假日定人定责定时进行信访包干，确保不出问题。全年共接待人民群众来信67件，接待群众来访90批次，受理信访事项75项，办结72项，办结率96%，办结信访事项停访息诉率达95%。全年无进京访，无非正常上访。
五、法制队伍建设情况。
（一）学习《公安部关于进一步加强公安法制队伍履职能力建设的意见》后，法制室及时组织全体民警召开专题工作会议。会议上，黄荣州主任组织民警认真学习贯彻《公安部关于进一步加强公安法制队伍履职能力建设的意见》，强调要紧密结合本地公安法制工作的实际，全面加强公安法制建设，切实提高公安法制队伍履职能力，充分发挥公安法制部门职能作用，切实把成效体现到做好各项公安工作，全力维护好国家安全和社会稳定上，完成好党和人民赋予的职责使命，以优异成绩迎接党的十八大胜利召开。同时，根据《公安部关于进一步加强公安法制队伍履职能力建设的意见》的文件精神，结合本地公安工作实际，制定出落实本意见的具体工作意见，细化各项任务目标，明确进度安排，狠抓工作落实，确保取得实效。
（二）开展“三访三评”、深化“大走访”，组织开展“规范执法警营开放日”等工作情况。
1、自“三访三评”活动开展以来，我科室领导高度重视，召开全体人员会议，组织民警认真学习贯彻省厅、市、县会议精神，传达县局文件方案，积极开展“三访三评”爱民实践活动，要求每名民警都要牢记此次活动的指导思想，目标任务、工作重点及方法步骤，认真开展公安民警“三访三评”爱民实践活动。自活动开展以来，共走访辖区群众130户，其中返乡务工人员24人，困难户、低保户11户，走访重点人口、两劳释放人员6人，回访案件当事人45人，其他群众46人，使“三访三评”活动取得实效，受到人民群众的好评。
2、为向广大人民群众直接展示开展执法规范化建设以来，我县公安机关在执法方面取得的可惜变化，加强与人民群众的联系与沟通，发现公安机关在执法工作中存在的不足，促进公安机关和民警牢固树立规范执法的意识、规范执法行为，进一步改进工作，提高公安机关执法公信力，我局通过定期召开治安情况通报会等方式，开展“规范执法警营开放日”活动。
（三）开展开展“12.4全国法制宣传日”宣传活动。
六、2013年公安法制工作计划。
一是抓培训，促能力提高。严格落实公安部“三个必训”、领导干部法律学习培训制度和“确保每名民警每年累计不少于15天培训”的要求，将全局公安民警分为领导干部、普通民警、专业技术人员、新录用民警四类，针对不同岗位制定不同的培训重点科目，突出实效，着力提高民警的实战能力。在具体培训中注重创新培训方法，由法制室牵头成立“说法论坛”，通过案例析理，以案释法，总结经验。同时，不定期地抽检部分案件进行实例评析，指导民警规范办案。
二是抓考评，促机制带动。为进一步规范民警执法，县局定期或是不定期地组织执法质量考评，使考评活动常态化、制度化。通过考评，县局及时发现民警在执法过程中问题与不足，并督促相关单位和民警进行改正。在考评的同时，发现典型，树立典型，并充分发挥典型的标杆作用。
三是抓奖惩，促责任到位。建立执法质量评价和奖惩机制，明确执法单位和民警的工作实绩与评先评优、晋职晋级、记功奖励、经济待遇和责任查究等挂钩。一方面，通过建立单位和民警的执法档案，对所有办案单位和民警的执法质量进行评分，排出名次，对执法质量落后民警实行评先评优一票否决制度和到法制部门跟班学习制度。对发生执法过错的，严格依照《公安机关执法过错责任追究规定》予以追究；另一方面，对年度考评优胜单位予以表彰奖励，对优秀人员优先晋职晋级。通过一系列奖惩措施，进一步激发了民警规范执法的动力，促进了全局执法质量的提升。

2. System construction and training
(1) Invite professors from colleges and universities to give special lectures to the county bureau.

3. Handling of reeducation through labor and reconsideration litigation cases.

Throughout the year, our bureau has handled 4 cases of labor education approval and 11 persons. Among them, 10 people are executing outside the institute, and 1 person is applying for executing outside the institute. A total of 8 people were sentenced to 1 year of reeducation through labor, 1 person was sentenced to 1 year and 3 months, and 2 people were sentenced to 1 year and 6 months. No public hearing was held.
(2) Handling of reconsideration cases.
Throughout the year, 1 reconsideration case was accepted, and the plaintiff withdrew the application for reconsideration; 2 litigation cases were accepted, 1 was upheld by the court, and 1 was dismissed; there was no state compensation case.
Fourth, the supervision of law enforcement.
(1) Conscientiously carry out the 2012 annual law enforcement quality evaluation work.
In accordance with the evaluation requirements of the "Implementation Measures for the Evaluation and Evaluation of Law Enforcement Quality of Public Security Organs in Jiangxi Province", we will comprehensively do a good job in the evaluation of law enforcement. At the end of December 2011, our bureau organized the selection of ten high-quality cases and ten low-quality cases of public security organs in the county. At the same time, it also makes the case-handling units realize the concept of firmly establishing law enforcement, so as to continuously improve the quality and level of law enforcement by public security.
(3) Handling of letters and visits.
This year, the county bureau has added a policeman for the petition work, and redecorated the lobby on the first floor of the county bureau, and set up a petition reception room to ensure that there are leaders on duty every day to receive petitioners. Irregularly clean up, investigate and deal with legal-related and litigation-related petition cases, check for unstable factors, and appoint people and responsibilities on major holidays to carry out petitions and visits on a regular basis to ensure that there are no problems. Throughout the year, a total of 67 letters from the people were received, 90 batches of visits from the masses were received, 75 letters and visits were accepted, and 72 were completed, with a completion rate of 96% and a cessation rate of 95%. No visits to Beijing throughout the year, no abnormal petitions.
5. The construction of the legal team.
