一年来，法制大队工作在县局党委正确领导和市局法制支队的指导下，贯彻落实全国公安机关执法规范化建设阶段总结推进会精神，按照法制工作“为公安中心工作服务，为领导决策服务，为基层执法办案服务”和公安部“三项建设”、“三项重点工作”的要求，以抓好执法规范化建设这条主线，努力提高执法质量为目标的指导思想，以”三访三评”、
“集中整治影响发展环境的干部作风突出问题”活动为载体，狠抓执法思想、执法主体建设，建立健全执法制度，深入贯彻《公安部关于进一步加强公安法制队伍履职能力建设的意见》，将执法规范化建设工作贯穿于公安执法活动的各个环节，改进执法方式，规范执法行为，在全局民警的共同积极努力下，我局执法质量和公信力逐年提升。今年我局被省公安厅授予“全省公安机关推动执法规范化建设红旗单位”，被市公安局授予“全市公安机关推动执法规范化建设红旗单位”及“全市公安机关执法质量排头兵”荣誉称号，执法质量考评成绩列全市18个县（市）区公安局第一名。现将大队全年法制工作总结报告如下：
一、执法主体建设、培训工作
1、执法思想建设情况。以贯彻落实《公安部关于进一步加强公安法制队伍履职能力建设的意见》（公通字［2012］36号）和《关于认真学习贯彻〈公安部关于进一步加强公安法制队伍履职能力建设的意见〉的通知》（公法［2012］680号）精神为契机，民警除参加县局组织的集体学习外，法制大队坚持每周一组织民警学习十八大精神，学习科学发展观重要论述读本，学习公安部《五条禁令》、“八条纪律四个严禁”、《公安机关领导干部五个严禁》、《公安机关执法细则》、《公安机关人民警察纪律条令》，深化社会主义法治理念教育，端正执法思想，开展“以案析理”、“以案释法”活动，查摆分析每一个执法环节和每一个执法行为中存在的问题，加强执法办案技能培训，通过层层落实执法责任状的方式，坚决查处以权谋私，徇私枉法，不作为、乱作为等执法不严，执法不公的违法行为，确保公安队伍的纯洁性。通过教育、整治和执法主体培训活动，进一步解决“为谁掌权、为谁执法、为谁服务”的思想认识问题，努力克服特权思想和地方、部门保护主义思想，坚决杜绝漠视群众疾苦、伤害群众感情、损害群众利益等问题。
2、开展“三访三评”活动情况；
“三访三评”是公安机关深化大走访活动的延续，对加强和改进公安工作和队伍建设，优化和提升服务群众工作水平，实现公安工作科学发展具有重要意义，更是贯彻党的群众路线，构建和谐警民关系的重要举措。我大队于今年2月9日召开座谈会，从队伍管理、工作任务、纪律作风养成等各个方面取得的成绩和存在的问题，在民警中开展“四查”，深入推进“三评三访”活动，并提出了五项公开承诺：一是改进工作作风，提高办案效率；二是坚持调解优先，案结事了，积极将信访矛头化解在萌芽状态；三是规范执法；四是加强队伍建设；五是加强党风廉政建设。二是紧扣活动开展法律咨询。
3、法制民警教育、培训情况；
提高民警执法素质，是规范执法行为，提升执法质量的基本途径和治本措施。我局非常重视执法培训工作，一是将执法规范化培训与常规的“三个必训”、“战训合一、轮值轮训”培训活动有机的结合起来。将法律法规和执法办案规定列如三个必训、轮值轮训培训的重要内容。在培训中，着重从执法思想理念、执法素养、执法行为规范、法律法规知识、业务技能、发生在身边的正反两方面的典型案件进行剖析讲解等方面进行了广泛的培训教育，不断提升了我局民警“理性、平和、文明、规范”执法的理念和素养。二是结合执法工作实际，按对象、分层次，开展各类特色培训。为解决经常出现的执法问题开辟了“法制小讲堂”，切实提高民警执法水平。一年来，为切实提高民警执法水平，促进执法规范化建设工作，我局组织各警种执法民警学习新《刑事诉讼法》、《行政强制法》、《江西省公安机关执法质量考核评议实施办法》、《公安机关执法细则》等培训工作。通过组织培训及考试，促进了民警认真学习规范、熟练掌握规范、自觉遵守规范和准确执行规范，真正达到了增加执法能力、提升执法水平、提高执法质量的目的。三是落实旁听庭审制度。一年来，我局共组织办案民警、法制审核员、兼职法制员旁听公安机关承办的重大、疑难、复杂刑事案件庭审12次560余人。通过现场观摹，切实增强了民警的证据意识、诉讼意识和程序意识。
4、贯彻新《刑事诉讼法》情况。
为推动全市公安民警深入学习、正确执行修改后的刑事诉讼法，进一步提高公安民警依法履职能力，全局形成了人人学习、讨论、研究新《刑事诉讼法》的浓厚氛围。我们做好了以下工作狠抓修改后《刑事诉讼法》贯彻实施的各项准备工作。一是开展对执法软件与硬件、场所与保障、队伍与机构等情况进行调查研究，发现与贯彻实施不适应、不配套的软硬件建设和可能遇到的问题，提出完善意见和要求。承担刑事执法职能的警种，对涉及本警种的修改内容进行梳理，提出应对方案，完善工作机制，以适应修改后《刑事诉讼法》对执法工作提出的新要求。二是加强教育培训。加强学习培训，使执法民警掌握、理解修改立法精神和内容，是正确贯彻落实的关键。一方面开展警种培训。各警种制定学习、培训计划，集中培训和警种自我培训相结合；另外开展教育培训。修改后《刑事诉讼法》作为今年培训的核心课程，纳入全局年度培训计划中。今年我局先后3次分别邀请公安部警官训练部培训组组长余强生、江西公安高等学院教授邓国良等专
5、谋划和备战中级执法资格等级考试情况；
公安部制定《公安机关人民警察执法资格等级考试办法》，在全国公安机关大力推行执法资格等级考试制度，对全面提高公安民警执法素质和执法办案水平具有积极而重大的意义。为认真贯彻落实公安部要求，局党委高度重视这一工作，严格按照市局领导提出的“高参考率、高通过率、高优秀率”要求，召开专门会议布置中级执法资格等级考试工作，成立了考务办公室，由法制、督察、警务保障等多警种齐心协力共同组织，广大民警积极学习法律及业务知识、踊跃报名参考。此次中级执法资格等级考试，我局共280人报名参加，占全局民警人数的66 %，参考人数272人，参考率达99 %。由于组织保障有力，安排严密，各类参考信息报送准确无误，我局中级执法资格等级考试得以顺利进行。
二、加强执法信息化建设
（一）网上执法办案情况
为推进执法规范化建设，强化执法管理，堵塞执法漏洞，提高执法效率，提升执法质量，我局从2009年全面推动网上执法办案，全部案件通过案事件系统进行审核审批，在案件审核审批过程中，行政案件、刑事案件证据材料均能及时上传。严格遵照《江西省公安机关案件网外流转审批报备规定》的相关要求，年内所有案件全程网上审批，有16起网外流转的案件也全部履行案件报备手续。戴止
所有案件均进行网上执法监督，主要从案件事实是否清楚，证据是否确实充分，适用法律是否正确，程序是否合法，处理意见是否适当，文书是否规范，证据是否及时上传等方面进行监督，及时发现问题，纠正执法偏差。并且对于拒绝接受执法监督、无故拖延履行监督决定或未按规定要求进行整改的责任人和其他相关人员进行责任追究。
在案事件系统中录入执法单位和民警的执法档案，完整记载执法数量、执法质量、执法培训、考核结果、执法过错责任追究等情况。
加强网上巡查，严格查处体外循环案件。全面落实网上监督和网上考评，实现对执法办案的全程化、实时化、动态化监督管理，推动网上执法办案规范健康发展。
积极开展网上执法服务。
（二）推动执法办案场所功能建设和规范使用管理情况；
1、根据公安部《公安机关执法办案场所设置规范》、省公安厅《2010—2012全省公安机关执法规范化建设各警种工作任务和责任分工表》和市局《赣州市公安局关于执法办案场所功能分区改造建设的实施方案》，为推动全县执法办案场所功能分区改造建设工作，制定实施了《赣县公安局关于执法办案场所功能分区改造建设的实施方案》，并成立了相应的领导小组。截止

（三）积极培养、创建执法示范单位
今年5月，根据《关于创建执法示范单位的实施意见》要求，对照基层所队执法示范单位创建标准，我局从执法主体建设、执法制度执行、执法行为规范化建设、执法质量、执法监督等方面对所属23个执法单位进行考评，推荐田村派出所、茅店派出所、吉埠派出所申报全市公安机关基层所队执法示范单位。
（四）组织开展“规范执法警营开放日”活动情况。
按照上级公安机关《关于开展规范执法警营开放日》活动的要求，主动向局领导汇报, 并结合我局的工作实际，事先安排部署，制定工作方案，于
三、强化执法监督工作力度，确保执法质量

（二）、严把了案件审核关，提高了案件质量。重点狠抓了对案件及采取刑事强制措施的审核把关工作。尽量把执法中的各种问题纠正于作出决定之前。行政案件抓领导审批前，刑事案件抓使用、变更强制措施前，坚持行政案件法制大队未审核，领导不裁决，刑事案件未经法制大队审核，领导不签批。今年1月至
（三）开展“突出执法问题整治”、“另案处理”专项治理活动情况；
1、我局开展以整治执法突出问题的执法规范化建设，从抓执法重点环节、重点岗位、重点问题入手，着力整改一批突出执法问题、治安问题和队伍问题，实现以整改促规范、促建设、促管理，有效提升执法公信力。
一是学整结合，以多面教育促执法意识规范。将加强学习贯穿于执法突出问题专项整治的始终，边整改边学习，以学习推进整改、夯实规范执法思想根基。积极组织民警重温执法中常见常用的法律法规和应知应会的岗位技能、学习执法质量考评通报、执法违纪违规典型案例，并开展交流讨论，引导民警认识执法问题背后的深层次根源，防微杜渐在平时、在源头。同时，组织民警从手头案件查起，针对发现的问题，进行查漏补缺式的学习。二是查改同步，以完善监督体系促执法行为规范。突出执法问题整治作为提升执法公信力的有效手段，群众的满意度成为检验整治成效的第一标准。将整治活动与“大走访”开门评警、涉案财物整治、涉案人员非正常死亡问题整治等活动有机结合起来，不断扩大群众知晓度、参与面，丰富执法监督主体，完善执法监督体系。坚持把突出执法问题整治作为提升执法质量的突破口，对办理的案件和警综平台案件信息逐一梳理，让民警人人参与受教育。在专项整治的同时，不断强化法制员的审核审批责任。加强案件审核把关力度，凡案件办理中存在问题的，坚决不予批准，一律退回，直到达标；对问题严重的，下发整改通知书。加强审核把关，并定期开展执法检查评审，不定期开展执法回访，进一步完善执法监督链。

四、积极开展优劣质案件评选活动
我局田村派出所办理的《黄老姑虚构事实扰乱社会秩序案》被评为2011年度省厅十大优质案件。这是我局继2009年后连续三年荣获省十大优质案件。按照《江西省公安机关执法质量考核评议实施办法》的规定，我局也在全局范围开展优劣质案件的评选，评出全局十大优、劣质案件，奖优罚劣，全局各办案单位均力争多办案，办好案。
五、劳教及复议案件办理情况
一年来我局法制部门继续认真贯彻落实公安部《公安机关办理劳动教养案件规定》和《关于进一步加强和改进劳动教养审批工作的意见》，严格执行劳动教养审批条件和办案程序规定，增强劳动教养办案程序的公开性和透明度，使每一起案件都做到事实清楚、证据确实充分，法律手续完备，经得起复议或诉讼的考验，确实保护公民的合法权益，有效地利用劳动教养手段惩治违法犯罪活动。截止
六、信访工作
2012年局党委高度重视控申维稳工作，确定四名法制大队民警负责控申、维稳工作，认真办理各类信访案件。在工作中法制大队按公安机关的要求，针对我县土地征用、房屋拆迁等方面的突出治安问题，积极预防和有效处置各类信访突出问题，及时发现影响社会稳定的苗头性、倾向性问题，提早介入，超前化解，主动解答群众到访的涉及刑事、治安案件和各类劳务纠纷中存在的矛盾问题，积极做好来访人员的引导疏导劝解工作，为群众提供法律帮助，消除思想疑虑，确保了因涉法涉诉案件而影响社会大局稳定的问题。认真开展重信重访件案件排查，对排查出的信访苗头及进做好化解工作，在处理各项信访事务中始终坚持“三认真”，即认真听、认真查、认真办，把信访接待摆上重要日程，维护好信访人员的合法权益，督促基层把化解群众矛盾常态化，规范化。特别是上半年通过不懈努力，做了大量艰苦细致的思想工作。真正做到了让县委、县政府及上级公安机关放心，信访当事人满意。我局今年截止
七、法制调研和信息工作
1、围绕公安中心工作，组织开展法制调研三次。写出调查报告三篇《农村留守孩违法犯罪现状、成因及预防措施》《劳动教养制度缺陷及改进措施研究》、《论法治社会与公安执法改进》。
2、法制信息工作：我局法制部门向我局局域网上传信息60条，采用52条；向市局法制网上传信息43条，刊载37条；市局主页刊载25条,省厅内网主页刊载3条,省厅外网刊载1条.
八、明年工作设想
明年我局将紧紧围绕上级执法规范化建设的有关要求，借鉴兄弟单位好的经验和做法，结合自身实际，量身定做涵盖公安执法各个领域的规范的执法制度，狠抓落实，使执法规范化建设的触角深入到各单位、各警种。
1、继续深入开展执法规范化建设。要组织专门力量，精心部署，全面推进执法规范化建设。通过创新执法理念、推进执法信息化建设、改进执法方式、完善执法规范、加强执法管理，实现执法思想进一步端正、执法信息化程度进一步提升、执法主体进一步规范、执法制度进一步健全、执法行为进一步规范、执法监督进一步有效，确保严格、公正、文明、理性执法。
2、进一步推进法制信息化建设。充分利用信息化这一有效手段，积极推行执法办案的网上流程管理、网上审批、网上监督和网上考评，把信息化手段渗透到执法办案的各个环节，加强法制网页的建设，利用法制信息网站加强网上执法指导和服务，提高执法效率，节约执法成本。
3、狠抓法制工作绩效考评。要充分发挥法制部门的职能作用，将法制业务工作分解量化，细化考核，突出法制工作在执法工作中的组织、规划、协调、推动的作用，强化能力建设，为执法工作发挥应有的作用。
4、强化执法监督工作。加大日常考评的力度，边评边整，不断提升规范执法的水平，采取措施，不断提高基层日常考评的自觉性。我大队将采取随机抽评、分警种集中考评、排名通报的方式，抓好执法质量考评，与控申、信访、新闻媒体曝光的案件联系起来进行全方位考评。
5、加强法制队伍自身建设。严格队伍教育监督管理，进一步提高公安法制战线队伍的整体素质，要建立学习型、创新型、研究型法制队伍，为公安工作的健康开展提供法制保障。
