关于张子鹏信访事项办理情况的报告

县政法委：

我局办理的“千案攻坚”交办张子鹏信访事项，局长刘德松签由我局苗集派出所依法办理，现将张子鹏信访事项的办理情况汇报如下：

一、信访人基本情况

张子鹏，男，55岁，住安徽省太和县苗集镇汽车站。

二、信访事项

信访人反映2010年9月28日，其遭窦化运等人伤害等问题。

三、信访事项办理情况

经查：2010年2月20日，张子鹏的儿子张建波将司陆军私自营运的五菱车查扣，司陆军找到其姐夫窦海涛去要车。窦海涛到张子鹏车站后，与张子鹏的儿媳妇刘敏发生纠纷，将刘敏打伤。后司陆军持菜刀来到车站，将张子鹏的衣服砍烂，张子鹏的儿子张中卫对司陆军进行了殴打，经鉴定刘敏和司陆军的伤情均为轻伤。我局接警后，迅速进行了调查，在调查期间，2010年8月30日，双方达成和解协议，由窦海涛赔偿6万元。双方互不追究对方的法律责任,后我局对此案撤案。2010年9月28日下午,张子鹏到苗集镇苗慧家电城买灯泡时,与窦化运妻子杨翠英(窦海涛的母亲)发生争吵,后双方发生厮打,经鉴定张子朋、杨翠英的伤情均为轻伤。现双方均申请对对方的伤情重新鉴定,在重新鉴定期间,2011年2月16日、17日经中间人调解达成和解协议,由窦化运一方补偿张子鹏5万元,双方撤诉,不再追究对方的法律责任,现已实际履行。2011年2月17日,我局对张子鹏进行了回访,张子鹏对我局的工作表示满意,承诺不再信访.

四、案件评查意见

1、办案民警对法律效果和社会效果把握不准，对信访人解释说服不到位，是信访人信访的主要原因。

2、在调解无果的情况下，未全面汇报案件情况，导致案件迟迟未有结论。

五、整改落实情况

1、针对上述存在的问题，我局已要求相关单位提高认识,认真加以整改。

综上所述,根据《信访条例》和《公安机关信访工作规定》，张子鹏的信访事项已办结。

Report on the handling of Zhang Zipeng's letters and visits

County Politics and Law Committee:

The "Thousand Cases" handled by our bureau assigned Zhang Zipeng's letters and visits. Director Liu Desong signed and the Miaoji Police Station of our bureau handled them in accordance with the law. The handling of Zhang Zipeng's letters and visits is hereby reported as follows:

1. Basic information of petitioners

Zhang Zipeng, male, 55 years old, lives at the bus station of Miaoji Town, Taihe County, Anhui Province.

2. Letters and visits

The petitioner reported that on September 28, 2010, he was injured by Dou Huayun and others.

3. Handling of Letters and Visits

After investigation: On February 20, 2010, Zhang Zipeng's son Zhang Jianbo seized the Wuling car operated by Si Jun privately, and Si Jun asked his brother-in-law Dou Haitao to ask for the car. After Dou Haitao arrived at Zhang Zipeng Station, he had a dispute with Zhang Zipeng's daughter-in-law Liu Min and injured Liu Min. Later, Si Jun came to the station with a kitchen knife and chopped up Zhang Zipeng's clothes. Zhang Zipeng's son Zhang Zhongwei beat Si Jun. It was identified that both Liu Min and Si Jun were slightly injured. After receiving the police, our bureau quickly conducted an investigation. During the investigation, on August 30, 2010, the two parties reached a settlement agreement, and Dou Haitao compensated 60,000 yuan. The two parties did not pursue each other's legal responsibilities, and our bureau later withdrew the case. On the afternoon of September 28, 2010, when Zhang Zipeng went to buy light bulbs in Miaohui Home Appliance City, Miaoji Town, he had an argument with Dou Huayun's wife, Yang Cuiying (Dou Haitao's mother), and then they fought. It was determined that Zhang Zipeng's and Yang Cuiying's injuries were minor hurt. Now both parties are applying for a re-appraisal of the other party's injury. During the re-appraisal period, on February 16 and 17, 2011, a settlement agreement was reached through intermediary mediation. Dou Huayun will compensate Zhang Zipeng 50,000 yuan. The legal responsibility of the other party has been actually fulfilled. On February 17, 2011, our bureau paid a return visit to Zhang Zipeng. Zhang Zipeng expressed his satisfaction with the work of our bureau and promised not to petition again.

4. Case review opinion

1. The police handling the case are not sure about the legal effects and social effects, and the explanations to the petitioners are not in place, which are the main reasons for the petitioners to petition.

2. When the mediation failed, the situation of the case was not fully reported, resulting in a delay in the conclusion of the case.

V. Implementation of rectification

1. In response to the above-mentioned problems, our bureau has asked the relevant units to raise awareness and seriously rectify them.

To sum up, according to the "Regulations on Complaints and Visits" and the "Regulations on Complaints and Visits by Public Security Organs", Zhang Zipeng's complaints have been completed.
