重点信访案件化解情况的通报

 

各市、州公安局交警支队,甘肃矿区公安局交警支队,高速公路各支队:

全省公安交警系统开展重点信访案件专项治理攻坚行动以来,各级公安交管部门高度重视,精心组织,强力推进,按照公安部、省厅和厅交管局的部署要求,迅速召开重点信访案件专项治理攻坚行动会,对中央政法委、公安部和厅交管局交办重点信访案件进行全面梳理,实行领导包案,制定化解措施,一批重点赴省进京案件得以化解。截至6月底,中政委和公安部交办的13起涉及道路交通事故的重点信访案件全部化解,厅交管局交办的24起信访积案全部结案息诉,新增的21起案件中17起结案息诉,重点信访案件专项治理取得明显成效。其中,金昌、平凉及高速公路第一、三支队无重点信访案件;白银、武威、定西、庆阳、陇南、临夏、高速公路第二支队措施得力,效果明显;兰州、嘉峪关、天水、酒泉、张掖、高速公路第四支队综合施策,工作力度大,专项攻坚行动取得实效。现将有关情况通报如下:

一、领导重视,全面部署,扎实推进专项治理工作

全省各级公安交管部门把重点信访案件专项攻坚行动作为一项政治任务来抓,成立了主要负责同志任组长的“重点信访案件专项治理攻坚行动领导小组”,17个支队主要领导与总队签订了重点信访案件专项治理目标责任书,13个支队队制定了《重点信访案件专项治理攻坚行动实施方案》,6个支队下发了“领导包案”的专门通知,8个支队向总队上报了无赴省进京上访 “承诺书”。白银、庆阳、酒泉、甘南及时召开视频调度会,对交办案件进行了全面安排部署。白银支队对照厅交管局通报,召集事故、法制部门逐案梳理,拿出化解意见,并向各县区下发了《关于贯彻电视电话会议精神全力推进重点信访案件专项治理攻坚行动的通知》,提出具体化解措施。庆阳支队就贯彻厅交管局“2.21”会议精神进行了全面安排和部署,明确了任务目标和办结时限,提出了具体的工作要求。酒泉支队召开重点信访案件专项治理攻坚行动通报会,对各级交办的11起重点信访案件的办理进展情况逐案进行了点评通报。天水支队就重点信访案件实行领导包案专门下发通知。陇南支队照信访包案工作的“五个一”以及“五包”要求,进一步量化、细化工作措施,促进了重点信访案件化解工作的有效实施。

二、多措并举,集中攻坚,狠抓重点疑难案件化解

公安部、中政委交办的13起信访案件和厅交管局交办的24起信访积案,大多时间跨度长,工作空间小,骨头案、钉子案、多部门“扯皮案”较多,各支队迎难而上,认真分析研究信访人的实际诉求,灵活运用多种策略方法,适时调整破解方案,积极协调相关各方,综合施策、全力化解,提前完成了6月底前信访积案100%化解息诉的目标任务。陇南支队会同市公安局控申部门负责人、信访人所在单位负责人、责任单位主要领导和办案民警召开重点信访工作协调会,分析交办重点信访案件的症结所在,并就如何配合做好息诉罢访化解工作提出了解决的途径。针对公案部交办唐丁有信访案,支队充分发挥信访协调工作机制,积极汇报政府,主动协调相关部门,多渠道解决当事人的实际困难,成功化解一起刑事和交通事故综合案件。嘉峪关支队积极向市委政法委汇报交办案件情况,市委政法委副书记焦多宏主持召开了由市公安局、检察院、法院、司法局和交警支队及信访部门负责人参加的联合会议,对重点疑难信访案件进行评析,对未办结的重点信访案件进行研究和督办临夏支队积极制定化解方案,成立调查息诉工作组,多次开展上门回访,做化解疏导工作。针对马全录16年信访积案,年年都上访,年年都没得到彻底解决的现状,支队主要领导亲自指挥调度案件办理,带队驻点指导、走访回访上访当事人,协调社会、宗教界各种力量化解信访积案。酒泉支队主要领导亲自包案,带领支队相关部门人员相继走访事故双方当事人、大队办案民警、法院办案人员,协调各方,在上诉前与中级法院通力合作,终于在中级法院审诉判决前达成了损害赔偿协议,成功地调解了一起对交通事故责任认定不服的信访案件。

三、因案施策,集中化解,在“案结事了”上下功夫

各地严格对照公安机关重点信访案件专项治理要求和厅交管局电视电话会议精神,以停访息诉为目标,以源头治理为根本,推动案件化解工作。一是对移交法院的案件或法院已裁定判决的案件仍上访的,积极做当事人的工作,引导当事人通过司法途径解决问题。白银、武威、陇南及高速公路第二支队积极开展重点信访案件专项治理攻坚行动,主动协调相关部门或事故双方当事人,耐心讲法、讲理、讲情,引导信访人思想转化,以“情”为纽带、靠“理”解心结、用“法”化矛盾,成功化解了公安部、中央政法委及厅交管局督办的顾明翠、刘生明、周佳、王伯文、唐丁有、张广星等多起重点信访案件。二是对一些道路交通肇事逃逸、无条件侦破的案件,积极做实“案未结”实现“事了”工作。兰州支队在办理王万霞交通肇事逃逸信访案件中,针对王万霞家庭困难实际,积极为其协调筹集医药费并主动为其找工作,经耐心细致的工作和真心实意地帮扶,信访当事人自愿写下了息诉保证书,保证以后不再上访;在办理朱喜全交通肇事逃逸信访案中,虽上访人对交警部门的工作予以理解,承诺不再上访,兰州支队仍继续穷尽一切手段全力侦破,用真情消除隔阂,用真心争取理解。三是对事实清楚,诉求明显不合理的案件,做耐心说理释法工作,让信访人了解政策、法律、了解事实真相,理清信访事项的因果关系,打开“心结”,促其停访息诉。天水支队办理公安部交办公安部特邀监督员王西林转递反映天水市渭南中学教师雷文田与酒驾的吴喜喜发生交通事故信访案件中,办案单位高度重视,对信访人的诉求及时复核调查,在事实清楚,证据充分的基础上,涉案单位派民警专赴信访转办人所在地延安,亲自说明案情及办理情况,信访转办人王西林对办案单位认真办案的态度给予了很高评价,表示愿做信访当事人的工作,促其息诉罢访。张掖支队在办理涉警信访案件中,积极配合市局秉公执法,责任追究到位,追偿救助到位,使一起公安部督办的案件迅速果断地得到了处理,并达成调解协议,取得了良好的法律效果和社会效果。定西支队对信访人反映的问题能逐项答复,用证据和事实引导当事人化解积怨,并通过联村联户为民富民行动,积极帮助信访人解决家庭实际困难,通过一定地帮扶救济促使了当事人的息诉。酒泉支队对肖占生交通事故信访案,能够依法严格处理,针对肖占生纠集150余名亲属围堵、闹访肃州交警大队的事实,酒泉支队在解释、劝说、警告无果的情况下,能依法严肃处理挑头闹事人,对15名人员强行带离现场,视情予以了刑事拘留和行政拘留。肖占生及其亲属在羁押过程中,认识到了自己的违法行为,承认了错误,并写下息诉罢访书,就此案件不再向任何公安、司法机关上访。

四、加强督导,强力推进,加快案件化解进程

全省交警系统推进重点信访案件专项治理攻坚行动电视电话会议后,各支队按照厅交管局“五个一律”的要求,全力化解重点信访案件。一些地区的骨头案、钉子案仍未得到有效化解,部分单位重点疑难信访案件化解工作进展缓慢,未取得实质进展。为进一步加快案件化解工作进程,41761,厅交管局派工作组,带案下访,逐案化解,先后深入4个片区11个支队和23个大队对24起案件进行了全力督办,“三级面对面会诊”,找症结、查原因,逐案研究未息诉的化解措施。兰州、嘉峪关、天水、酒泉、临夏、甘南支队主要领导,利用厅局督办的有利时期,亲自参加重点信访案件评析会,逐案分析查找引发信访问题的原因,研究提出办理意见。临夏、白银、定西及高速公路二支队8个支队先后派出工作组走访当事人,了解诉求、解疑释惑,积极做当事人矛盾化解工作,为及时化解矛盾纠纷起到了积极的推进作用。定西、陇南、天水、武威、临夏及高速公路第四支队等单位,将重点信访案件化解情况纳入年度信访工作目标考核范畴,予以量化考核,出台了《重点信访案件专项治理工作考核办法》。酒泉、庆阳、白银、嘉峪关、天水、张掖等支队专门召开个案矛盾化解推进会,多次召开个案评析会,抽调事故处理业务骨干组成专家组,采取听汇报、查阅案卷、与地方政府相关部门沟通、接访当事人等措施,全力推动化解进程。

五、下一步工作要求

重点信访案件专项治理工作以来,在全省各级公安交管部门的共同努力下,专项治理工作取得了显著成效,但我们要清醒的认识到,随着党的“十八大”日益临近,一些已化解的重点信访案件还有出现反复的可能,当事人择机赴省进京上访的倾向可能会更加明显,加之今年以来新增信访案件部分地区总量明显增加,个别案件还没得到有效化解,信访维稳的压力不容低估。鉴此,厅交管局要求:

(一)巩固成果,认真组织开展专项治理“回头看”活动。对可能反复的案件,要摸清底数,了解情况,随时做好思想工作,巩固既有战果,防止发生反弹,出现反复;对重点信访案件后续遗留问题,措施要跟上,承诺要解决的问题,要抓紧解决,不得进一步激化矛盾;对新增未化解案件,要集中精力、全力攻坚,涉案地交警部门“一把手”要亲自挂帅,包案化解,针对信访人的诉求,查清症结,综合施策,切实做到法理情相结合,信访群众满意息诉;对已化解案件各支队要组织开展全面评查,吸取教训,防止类似问题再次发生。

(二)全面排查,及时化解新发矛盾纠纷和信访问题。各级公交管部门要结合本地实际,认真组织矛盾纠纷排查工作,及时调处化解各类矛盾纠纷和信访问题,确保随时出现、随时化解,不留死角,着力将小纠纷、小问题、小隐患解决在初始阶段和萌芽状态,坚决防止小事拖大,大事拖炸,引发极端事件或群体性事件。要高度重视解决初信初访,带着责任和感情,在第一时间和第一关口受理好、解决好、答复好群众信访反映的诉求,确保把信访问题解决在首接首办阶段,切实把及时就地解决问题作为预防和减少越级访、重复访、进京访和非正常访的根本措施落到实处。

(三)强化措施,做好“十八大”信访安保工作。全省各级公安交管部门,要充分认识做好“十八大”安全保卫工作是当前压倒一切的首要政治任务,特别是各级主要领导干部,切实增强大局意识、忧患意识和责任意识,进一步加强对非正常上访重点人员的教育稳控,明确责任单位和责任领导、责任民警,逐人见面、逐人谈话、逐人落实稳控措施,加强重点人的日常管理、基础管理、动态管理,管住重点人,控住重点事,聚精会神、全力以赴,把接访下访作为信访安保工作的重要举措,突出接访重点、完善接访机制,最大限度地解决上访群众的诉求,最大限度地把上访群众吸附在当地。要建立民意研判和响应制度,及时把民意诉求转为警务工作决策部署,把人民群众的第一信号转为人民警察的第一行动,积极回应人民群众的新期待,新要求,以实际行动迎接“十八大”的胜利召开。

2. Take multiple measures simultaneously, focus on tackling key problems, and pay close attention to resolving key and difficult cases

All localities strictly complied with the special management requirements of public security organs for key petition cases and the spirit of the video conference of the traffic management bureau of the department, with the goal of stopping visits and cessation of complaints, and taking source governance as the basis to promote the resolution of cases. However, bone cases and nail cases in some areas have not been effectively resolved, and the resolution of key and difficult petition cases in some units has progressed slowly without substantial progress. 5. Requirements for the next step

Since the special treatment of key letters and visits, with the joint efforts of the public security traffic control departments at all levels in the province, the special treatment has achieved remarkable results, but we must be soberly aware that as the party's "18th National Congress" is approaching, some There is still a possibility that the key petition cases that have been resolved will be repeated, and the tendency of the parties to go to the province to appeal in Beijing may become more obvious. In addition, the total number of new petition cases in some areas has increased significantly since this year, and individual cases have not been effectively resolved. The pressure to maintain stability cannot be underestimated. In view of this, the Ministry of Traffic Management Bureau requires:


(1) Consolidate the achievements and conscientiously organize and carry out special governance "look back" activities. For cases that may be repeated, it is necessary to find out the bottom line, understand the situation, do a good job of ideological work at any time, consolidate the existing achievements, and prevent rebounds and recurrences; for the follow-up problems of key petition cases, the measures must keep up with the problems promised to be solved , to solve it as soon as possible, and not to further intensify the conflict; for new unresolved cases, it is necessary to concentrate and make every effort to tackle the problem. Measures should be taken to combine legal principles and circumstances, and the petitioners should be satisfied with complaints; each detachment should organize a comprehensive review of resolved cases, learn lessons, and prevent similar problems from happening again.


(2) Comprehensively investigate and resolve new conflicts and disputes and complaints in a timely manner.
