2012年6月3日，在北京市昌平区发生一起故意伤害他人致死案。 6月3日23时许，在北京市昌平区新华书店西侧尊鹏烧烤店前的大排档处，马书鹏与韩强在吃饭过程中发生纠纷。后马书鹏持刀将韩强扎伤，后经抢救无效死亡。
6月4日，马书鹏向公安机关自首。
一、接报案情况：
2012年6月3日23时35分许，昌平派出所接陈杰报案称：在北京市昌平区西街有人被扎伤。接报后民警迅速赶到现场开展工作。经了解得知：伤者为韩强，经抢救无效死亡。刑侦支队重案队于6月4日0时许接报后，立即组织警力赶到现场开展工作。
案件发生后，昌平分局副分局长徐桐、刑侦支队支队长王维继、政委徐雷涛、副支队长郭长海亲临现场指导工作，并责成重案中队、昌平派出所成立专案组迅速开展工作。
二、现场情况：
现场位于北京市昌平区新华书店西侧尊鹏烧烤店前的大排档6号桌处。
三、死者情况：
韩强，男，汉族，18岁，户籍地：北京市昌平区流村镇新建村361号，身份证号码：，工作单位：北京市昌平区森马专卖店导购。
四、调查访问情况：
1、经询问报案人陈杰（男，25岁，户籍地：北京市昌平区流村镇上店村，身份证号码：，，从事个体纹身店，电话：13911045640）得知：2012年6月3日20时许，陈杰、陈鑫刚、“小马”（经辨认确定为马书鹏）和两外两名女子（具体身份不详）一起到北京市昌平区西街新华书店西侧的大排档吃饭。后陈鑫刚的女朋友来后，另两名女子离开。喝酒期间，陈杰和“小马”在上厕所的过程中，“小马”曾说“刚才勾了一个小妞，说话挺搓火，边上还有一个男的也挺搓火”，并示意自己身上带着“东西”，但陈杰没看到具体是什么。后一男子（经辨认确定为韩强）来到他们吃饭的地方，“小马”说认识都是哥们。该男子与陈杰等人一起吃饭喝酒，过程中“小马”曾向该男子走去，但被陈杰拉开。陈杰离开打电话时得知出事了，返回吃饭地点时发现该男子浑身是血躺在地上，“小马”不知去向。
2、经询问陈鑫刚（外号：刚子，男，21岁，户籍地：北京市昌平区流村镇南流村145号，身份证号码：，无业，电话：13699258270、18801169741）得知：2012年6月3日18时许，陈鑫刚、陈杰和马书鹏到北京市昌平区新华书店西侧的烤串店吃饭。另有两名马书鹏叫来的女子（具体身份不详）一起吃饭。后贺梦岩来到一起吃饭，过了一会儿，该两名女子离开。大约当晚23时左右，韩强来到一起吃饭，不知什么原因马书鹏就到了韩强的身边，并挥舞手臂后。陈鑫刚见到韩强倒地，浑身是血。后陈鑫刚等人将韩强送至北京市昌平区医院。
3、经访问陈鑫刚的女朋友贺梦岩（女，20岁，户籍地：北京市昌平区流村镇北照台村18号，身份证号码：，电话：15001178912）得知：2012年6月3日19时许，陈鑫刚给贺梦岩打电话让她到北京市昌平区新华书店西侧的大排档吃饭。她于21时左右到达，当时陈鑫刚、陈杰和另一名男子在场，还有2名女子。过了一会儿，2名女子离开，在继续吃饭过程中又来了一名男子。大家在一起吃饭喝酒聊天，说话过程中其中一名男子向另外一名男子走去，并挥了两下手，另一名男子就倒在地上。后倒地男子被送到昌平区医院。经辨认确定倒地男子为韩强，另一名男子为马书鹏。
4、经访问刘丹（女，18岁，中国河南省驻马店人，电话：13581882593）得知：2012年6月3日晚，韩强在使用刘丹手机打电话过程中和对方骂了起来，并说让对方等着。后2人一起坐车到“尊鹏烧烤店”，刘丹在车上等着。韩强下车后就到了该烧烤店前的大排档处，在其中一张桌子坐了下来。当时还有3、4名男子和1名女子，大约半个小时后，她突然听到司机说那边打起来了，她赶过去发现韩强躺在地上，身上有血。后她和韩强同桌的男子将韩强送至医院。后韩强经抢救无效死亡。
5、经访问“尊鹏烧烤店”老板张洪文（男，32岁，中国黑龙江省宾县人，身份证号码：，电话：13522527222）得知：2012年6月3日23时30分许，在“尊鹏烧烤店”门前6号桌吃饭的4男1女中，2名男子发生冲突。其中一名男子持刀将另外一名男子扎伤，受伤男子流血倒地。后被计程车拉走。经辨认确定，持刀扎人男子为马书鹏，受伤男子为韩强。
5、经访问“尊鹏烧烤店”工作人员李得印（男，23岁，中国黑龙江省哈尔滨市人，身份证号码：，电话：15110149225）得知：2012年6月3日晚23时至4日0时之间，在该烧烤店6号桌吃饭的是4男1女。他见到其中一名男子右手持刀被他人推走，另一名男子躺在地上，身上有血。后他帮忙将躺在地上的男子送至计程车上，便继续工作了。经辨认确定，身上有血躺在地上的男子为韩强，右手持刀男子为马书鹏。
6、经访问“尊鹏烧烤店”工作人员高德龙（男，21岁，中国辽宁省葫芦岛市人，身份证号码：，电话：13296037633）得知：2012年6月3日20、21时许，在“尊鹏烧烤店”前吃饭的客人中，坐在桌子南侧的男子持刀将坐在桌子北侧的男子扎了，被扎男子倒在地上。后面的事情因他进屋给客人上菜就不知道了。再出来时，被扎伤男子已被送上车。经辨认确定被扎伤者为韩强。
7、经访问马维春（男，42岁，中国吉林省通榆县人，身份证号码：，电话：13522370407，系马书鹏的父亲）得知：2012年6月4日0时许，马书鹏回到昌平区流村镇南流村家中向马维春说，他持刀将他人扎伤了，现伤者在医院抢救，他要去公安机关自首。后马维春找到贾洪涛，2人陪同马书鹏投案。
8、经访问贾洪涛（男，31岁，户籍地：北京市昌平区流村镇南流村497号，电话：13811052335）得知：2012年6月3日23时许，他接到马书鹏的电话，称和别人打架把别人扎伤了。后他赶到马书鹏的家中，马书鹏称想自首，不知去哪里。后他和马维春陪同马书鹏向公安机关投案。
五、破案经过：
2012年6月4日1时许，犯罪嫌疑人马书鹏（男，20岁，汉族，户籍地：中国吉林省通榆县边昭镇西战村巨良屯，身份证号码：，无业）向昌平刑侦支队重案队投案，并在北京市昌平区流村镇流村环岛等待民警。重案队民警赶到北京市昌平区流村镇流村环岛处，将马书鹏传唤至昌平刑侦支队进行讯问。经讯问他供述：2012年6月3日晚，他和陈杰、陈鑫刚等人在北京市昌平区新华书店西侧的烤串店喝酒吃饭。期间其给前女友刘丹丹打电话让其一起过来吃饭，当时韩强（刘丹丹现男友）接的电话。后两人约在马书鹏等人吃饭地点见面。韩强于当日23时左右来到吃饭地点，与马书鹏等人一起吃饭。当时他坐在桌子的南侧，韩强坐在桌子的北侧。吃饭过程中他和韩强发生纠纷，后他持刀将韩强扎伤后离开现场。现马书鹏因涉嫌故意伤害，已被昌平公安分局刑事拘留。
至此，马书鹏故意伤害他人致死案成功告破。

On June 3, 2012, a case of deliberately injuring others to death occurred in Changping District, Beijing. At about 23:00 on June 3, Ma Shupeng and Han Qiang had a dispute while eating at the food stall in front of Zunpeng BBQ Restaurant on the west side of Xinhua Bookstore in Changping District, Beijing. Hou Ma Shupeng stabbed Han Qiang with a knife, and died after rescue efforts failed. On June 4, Ma Shupeng surrendered himself to the public security organs.
1. Reporting situation:
At about 23:35 on June 3, 2012, the Changping Police Station received a report from Chen Jie that someone had been stabbed in West Street, Changping District, Beijing. 4. Survey visits:
1. After questioning the reporter Chen Jie (male, 25 years old, household registration place: Shangdian Village, Liucun Town, Changping District, Beijing, ID number: ,, engaged in individual tattoo shop, telephone: 13911045640) learned: June 3, 2012 At about 20 o'clock on the same day, Chen Jie, Chen Xingang, "Little Ma" (identified as Ma Shupeng) and two women from two foreign countries (identities unknown) went to the food stall on the west side of Xinhua Bookstore, West Street, Changping District, Beijing for dinner. Upon inquiry, Chen Xingang (nickname: Gangzi, male, 21 years old, household registration: No. 145, Nanliu Village, Liucun Town, Changping District, Beijing, ID number: , unemployed, telephone: 13699258270, 18801169741) learned: 2012 At around 18:00 on June 3, Chen Xingang, Chen Jie and Ma Shupeng went to the barbecue restaurant on the west side of Xinhua Bookstore in Changping District, Beijing for dinner. Two other women (identities unknown) called by Ma Shupeng had dinner together. After He Mengyan came to eat together, after a while, the two women left. At around 23:00 that night, Han Qiang came to eat together. For some unknown reason, Ma Shupeng came to Han Qiang's side and waved his arms. After interviewing Liu Dan (female, 18 years old, from Zhumadian, Henan Province, China, Tel: 13581882593), it was learned that on the evening of June 3, 2012, Han Qiang scolded the other party while using Liu Dan’s mobile phone to make a call. And said to let the other party wait. After that, the two of them drove to "Zunpeng BBQ Restaurant" together, and Liu Dan was waiting in the car. After Han Qiang got off the car, he went to the food stall in front of the barbecue restaurant and sat down at one of the tables. At that time, there were 3 or 4 men and 1 woman. About half an hour later, she suddenly heard the driver say that there was a fight there. She rushed over and found Han Qiang lying on the ground with blood on his body. Later, the man she and Han Qiang were at the same table sent Han Qiang to the hospital. Later, Han Qiang died after rescue efforts failed.

After that, he helped to send the man lying on the ground to a taxi, and then continued to work. After identification, it was determined that the man lying on the ground with blood on his body was Han Qiang, and the man holding a knife in his right hand was Ma Shupeng.
6. After interviewing Gao Delong (male, 21 years old, from Huludao City, Liaoning Province, China, ID number:, Tel: 13296037633), a staff member of "Zunpeng Barbecue Restaurant", I learned that: June 3, 2012 at around 20 and 21 o'clock , Among the guests eating in front of "Zunpeng BBQ Restaurant", the man sitting on the south side of the table stabbed the man sitting on the north side of the table with a knife, and the man who was stabbed fell to the ground. After an interview with Ma Weichun (male, 42 years old, from Tongyu County, Jilin Province, China, ID number: 13522370407, Ma Shupeng's father), it was learned that Ma Shupeng returned to Changping at 0 o'clock on June 4, 2012 The family of Nanliu Village, District Liucun Township told Ma Weichun that he stabbed someone with a knife and that the wounded person was being rescued in the hospital, and that he would surrender himself to the public security organ. Later, Ma Weichun found Jia Hongtao, and the two accompanied Ma Shupeng to surrender.
8. After an interview with Jia Hongtao (male, 31 years old, household registration: No. 497, Nanliu Village, Liucun Town, Changping District, Beijing, telephone: 13811052335), it was learned that at around 23:00 on June 3, 2012, he received a call from Ma Shupeng , Said that fighting with others stabbed others.
