2012年7月13日1时22分，我队接支队值班室布警：在北京市丰台区六里桥桥下草坪上有人倒地，身上有血。接报后，我队侦查员在分局衡晓帆局长、赵磊砢副局长，刑侦支队王卓支队长的带领下，会同分局技术队侦查员及法医立即赶赴现场开展工作。同时到达现场还有刑侦总队副总队长臧学民、副总队长吕宝泉、市局十二总队、情报信息中心、网安处以及刑侦总队七支队、八大队、九支队和分局相关单位的同志。
一、接报案情况
报警人王琦（男，29岁，中国河北省承德市人，手机号：18310208206）反映：2012年7月12日14时许，王琦到六里桥长途汽车站东南方向的一个旅店住下，准备7月13日坐长途车回家。7月12日21时许，由于心情不好其独自一人离开暂住地出去遛弯。次日1时许，他由北向南穿过三环辅路到桥洞向西朝长途汽车站方向走时，看到路边草丛里躺着一个男子。头北脚南，仰卧躺在地上，右手拿了一把刀，面部、舌头有血，头部右下方有一块砖头。报警人见状后沿原路绕到京石高速内侧找到公用电话报警，后回到现场等待警察。
二、现场勘查及法医初检
（一）死者基本情况
经核实，死者徐清，男，49岁，身份证：，户籍地：北京市丰台区右安门开阳里三区18楼5门301室，现住址同户籍地，现为华北电力科技研究院有限责任公司工程师，手机号：13701271919，QQ号：425062582。
（二）现场勘查
经勘察，现场位于北京市丰台区六里桥西南角桥下三角绿化带内。尸体头西北脚东南呈仰卧状，上穿黑色背心，下穿浅色短裤，脚穿旅游鞋（无袜），右手握有黑色折迭刀（刃长6厘米，标识为鸿丰小刀）。尸体周边足迹种类较多，有条形、方块、圆圈、波浪等。滴落血迹从尸体向东延伸8米左右。现场提取黑色huawei牌手机1部（13701271919）及钱包1个，钱包内有人民币1082元，银行卡3张（招商银行：4391880502797727，工商银行：5309900056851023，北京银行：6029692019851474），公交IC卡1张：10007510316425131。
距死者西南20余米处有一计算机包，内有衣物、杂物若干，身份证一张，所有人为张泮有，男，1962年9月4日出生，身份证号：，户籍地：中国内蒙古赤峰市宁城县八里罕镇沙里营子村6组，现金300元人民币，均为100元整钱。
（三）法医检验情况
经法医初步检验，死者头部有钝器伤，左腋下和右大腿有刺创伤，左上臂有皮肤擦伤。死亡原因及其他具体情况待法医进一步检验。
作案工具应为40cm刃长，3cm刃宽的锐器，死者肺部、心脏贯通伤，头部有条形打击伤。
三、访问工作情况
黄金（男，30岁，中国重庆市城口县人，手机号：13996686339）反映：2012年7月13日零时许，黄金与朋友打完台球后，由于酒后就没开车，独自一人在六里桥附近沿马路慢跑。1时30分许，黄金慢跑至六里桥西南角时，发现有一男子头北脚南躺在路边草坪上，且脸上有血。据黄金回忆，他沿京石高速辅路南侧，由西向东慢跑距离六里桥约1公里时在路边碰到6、7个男子，其中有一个男子手持铁棍，但他不确定这几名男子与倒地的男子有无关联。
洪清河（男，20岁，中国福建省厦门市人，手机号：13559496217、15541222925）反映：2012年7月10日离开学校，次日11时许到达北京，18时许到达在“沙发客”网站上联系好的徐清家中。7月12日7时许离开徐清家，到北京各个景点参观。当晚20时许，回到徐清家，徐清正在家上网。大概22时许，徐清离开家。12日洪清河回到徐家后，徐清用手捏了捏洪清河的胳膊，并称他身材不错，后徐清又从正面拥抱，并亲吻了洪清河的脖子。
母亲张鹤仙（男，75岁，北京人，手机号：13521289216）反映：徐清在大学时交过一个女朋友，分手后没再交过女朋友。后张鹤仙多次劝徐清结婚，但徐清每次都很不高兴。4、5年前，徐清曾因为可怜一个流浪汉，后被流浪汉用刀扎伤抢钱。2012年7月12日，徐清曾给张鹤仙家中座机打电话问候她身体，找他妹妹徐婕未果后挂断。
妹妹徐婕（女，43岁，北京人，手机号：13911617869）反映：徐清大学毕业后一直自己居住。家里人一直关心徐清的婚姻问题，但徐清都以自己能解决为由拒绝。2012年7月12日9时许，徐清与徐婕曾电话联系，不久就挂了。最后一次见面是7月4日的中午12时许，兄妹二人一起在家徐婕家吃饭，饭后徐清离开上班。2004、2005年左右，徐清对徐婕称，曾被借住在他家中的男子抢劫，期间发生搏斗，徐清受伤。
丁孟峰（男，51岁，北京人，电话号：63768385）反映：丁孟峰是排水集团六里桥泵站看门工人。2012年7月12日23时许听见屋外特别大的“咣”的一声，以为是进小偷了。丁孟峰随从屋里窗户向外查看，屋外没有人就回去睡觉了。
张跃（男，30岁，北京人，手机号：13611327968）反映：2012年7月12日晚上，张跃与十余名同事一同喝酒。21时许，张跃由于不胜酒力，便回宿舍睡觉了。当晚23时许，张跃听到院西侧的小路上有人嚷了几声，声音挺急，持续了不到10秒钟，但张跃没理会便又睡觉。
四、前期侦查情况
（一）经到死者单位访问，徐清的同事均反映不清楚死者是否为同性恋者。平时与同事关系都很和谐，交际关系很好，但对他私生活不了解。经对死者单位计算机进行查控，没发现任何线索。
（二）网安部门经对死者QQ号码425062582聊天记录进行查看，没发现有在案发时间段内相约出去的消息。
（三）经技侦部门对死者手机进行查控，未发现有案发时间段内相约出去的信息。死者离开住地时间为7月12日21时50分，到达案发现场的时间为7月12日20时10分。
五、案情分析及下一步工作部署
经查控死者家中计算机以及他家属反映，确定死者应为一名同性恋者。根据现场遗留物品经分析，不排除图财的可能性，更倾向于矛盾因素类引起的故意伤害案件。
项目组经听取侦查员汇报，分析决定从以下几方面开展工作。
（一）向全市所属医院发布协查通报，查找案发后到医院进行就诊外伤的可疑人员。
（二）视频小组对案发周边、死者驻地及沿途可能途径地区进行发散式的监控录像调取。
（三）对现场周边进行同期访问，重点对现场周边劳务市场、混迹社会的闲杂人员进行访问。
（四）在现场周边、劳务市场等地布置特情耳目，查找线索。
（五）调取23时40分至24时的116出租车信息。
六、破案情况
7月15日，项目组接市局法医中心转递线索：现场提取到的滴落血迹与肖永志（男，30岁，中国辽宁省人）DNA认定同一。该人因涉嫌2012年6月25日的一起抢劫案，已于7月14日被朝阳分局刑事拘留。项目组立即提讯肖永志，该人供述与另一男子（回族，35岁左右，北京市通州人）于2012年7月12日23时许，在六里桥附近将受害人徐清扎伤致死。
项目组一方面加大对肖永志的讯问力度，另一方面全力查找另一名涉案嫌疑人。经从公安网调取符合基本情况的男子让嫌疑人肖永志辨认。肖永志辨认后确定本案的另外一名犯罪嫌疑人为马国建（男，回族，35岁，北京市通州区人）。案件出现重大转机，项目组立即与马国建户籍地张家湾派出所联系，了解到该人系派出所重点人员，并获取马国建的手机号码。专案组在市局十二总队协作下，于2012年7月17日11时许，在东单公园内将马国建抓获。经讯问，该人供述他与肖永志均为同性恋者，二人因在案发当天与受害人徐清发生纠纷，遂将徐清扎伤致死。
现两名犯罪嫌疑人肖永志、马国建已被分局刑事拘留，案件正在进一步审理中。

答：因为他骚扰我，走到我身边拉我的腰带，用左手搂着我的脖子不放，然后我就反抗，他就用刀将我划伤了。

答：那个男子大概40岁左右，1米75左右，体态中等，上身穿深色短袖T恤，手里拿着一把长约20厘米的刀子，其他情况我记不起来了。

答：我是去找我一个朋友。
问：把你要找的那个朋友的基本情况讲一下？
答：那人叫“马德”什么，只知道大家叫他“黑子”，回族，北京通州人，36岁左右，1米75左右，体态中等，长发往左偏分，较黑。
问：讲一下黑子当时的衣着？
答：黑子当时上身穿深色短袖T恤衫，下身穿深色裤子，脚穿深色皮鞋，手上戴着手表，具体哪只手戴不知道。
问：讲一下当时你的衣着？
答：当天晚上我上身穿的是白色圆领T恤，下身穿白色休闲裤，脚穿绿色休闲布鞋。
问：你把那天打架的详细情况讲一下？
答：2012年7月 12日晚上22时40分许，我从北三环蓟门桥公车站花了1.5元乘坐300路慢车。大概在当晚23时许到丰台区西局附近下的车。接着往北走到一立交桥边西南角的小树林里，找一个外号叫“黑子”的朋友。见到黑子后我就走到小树林西侧的一堵墙边站着，“黑子”就在小树林周边溜达。我在墙边站着的时候，迎面走来了一个男子。那个男子就开始骚扰我、骂我，我就开始反抗。他就拿出刀子划我，我的左胳膊两处被划伤。这时候黑子从我身后过来，具体从哪边过来我不知道。他手里拿着刀，就和那个男子打起来了，那男子就跑了。黑子大概追了他100米左右，在马路边上和那男子又打起来了，厮打在一起。等我过去的时候那个男子已经在地上躺着了，手里拿着刀向我比划着，没说话。然后黑子往马路北边的桥洞跑了。这时候我看到黑子用的那把刀扔在人行道中间，我就跑到桥洞底下朝黑子招手叫他回来把刀拿上。我们回到马路中间，黑子说刀不要了。我捡起刀子拿在手上，黑子向我要钱。我把兜里的钱给了他，自己就剩下二三十元。然后我把刀插进刀鞘拿着刀，和黑子一起向南走了。经过路边的卫生间时，我进里头洗的手和手臂上伤口的血。当时黑子就走了，怎么走的我不知道。然后我一直向南步行至三环路边。后来步行至木樨园到天亮，吃了早点，然后乘坐262路公交车到牡丹园。
问：当时黑子在厕所和你分开时说过什么？
答：黑子和我分开前跟我说这把刀不能再拿着了，赶紧处理掉。
问：你是否将刀处理了？
答：没来得及处理，我就被安贞里派出所民警抓获了，刀和随身物品都被派出所扣押了。
问：当时黑子受伤了吗？
答： 黑子左手手背有两处受伤，流了些血，具体受的什么伤我不清楚。
问：你和黑子是什么时候认识的？
答：我们认识大概两个多月。
问：你是怎么和黑子认识的？
答：我们是通过一个外号叫“小东北”的人介绍认识的。
问：讲一下小东北的基本情况？
答： 我和他是今年5月份在牡丹园认识的，就知道他外号叫“小东北”。他26岁左右，身高1米77左右，体态中等，长方脸，留寸头，常去工体附近的酒吧和牡丹园一带玩，其他情况我就不知道了。
问：你是通过什么方式约见黑子的？
答：我们第一次见面是在元大都遗址公园，黑子给我留了一个手机号码。我把手机号码记在了我一张车票上随身带着。想见面的时候，我们会通过电话联系。一般都是我通过公用电话给黑子打电话，或者是上一次见面就约好下一次见面的时间和地点。
问：你讲一下黑子的手机号码？
答： 我不记得了，因为我把他的号码记在了车票上，没有记在脑子里。
问：你随身带着的那张记着“黑子”手机号码的那张车票现在在哪？
答：2010年7月13日晚我被安贞里派出所抓获后，我身上的物品被安贞里派出所扣押了。
问：2012年7月12日晚上，你们见面是如何约的？
答：2012年7月12日晚上的见面是我们在2012年7月10日下午3点多在大钟寺见面的时候约好的。
问：你们去大钟寺做什么？
答： 2012年7月9日晚上22时许，按照我们上次约好的时间和地点，我们在朝阳区三里屯附近一个名叫“目的地”酒吧见面，一直玩到凌晨3点多我们就离开了。然后“黑子”说去一个朋友家，我就去西单逛街了。分开之前我们约好下午3点在大钟寺寺庙门口见面。当天下午3点半左右我和“黑子”在大钟寺门口见面，然后我们一起逛街。在逛街的时候我花了70元在一个新疆人的摊位上给黑子买了一把刀，之后一直是由黑子拿着这把刀。
问: 你们当时买的刀和黑子用的刀以及你被派出所抓获后被扣押的那把刀都是同一把刀吗？
答：是，三把刀都是同一把。
问：这把刀现在何处？
答：现在这把刀在安贞里派出所扣押。
问：你讲一下刀子的特征?
答：那把刀长约50公分左右，宽约3公分左右，一面带刃尖刀，有棕色皮质刀鞘。

At 1:22 on July 13, 2012, the duty room of our team's reception team deployed police: Someone fell to the ground with blood on the lawn under the bridge of Liuliqiao, Fengtai District, Beijing. 6. Case solving
On July 15, the project team received clues from the Forensic Medicine Center of the Municipal Bureau: the DNA of Xiao Yongzhi (male, 30 years old, from Liaoning Province) was identified as the same as that of Xiao Yongzhi (male, 30 years old, from Liaoning Province). The person was criminally detained by the Chaoyang Sub-bureau on July 14 on suspicion of a robbery case on June 25, 2012.
