2012年5月27日，在北京市昌平区发生一起故意伤害他人致死案。5月27日8时许，在北京市昌平区小汤山镇土沟村国家电网办公科研综合楼工地生活区东2-1-08宿舍内，嫌疑人木出支古日酒后与木出母呷子发生口角。后二人进行互殴，木出支古日持碎酒瓶将木出母呷子扎伤。后经抢救无效死亡，当日嫌疑人木出支古日被抓获。

一、接报案情况：

2012年5月27日9时35分，小汤山派出所接李世明电话报警称：在北京市昌平区小汤山镇未来科技城国网智能电网研究院工程工地有人打架。民警到现场后经了解得知：当日在北京市昌平区小汤山镇土沟村国家电网办公科研综合楼工地生活区东2-1-08宿舍内，木出支古日酒后与木出母呷子发生口角。后木出支古日持碎酒瓶将木出母呷子扎伤，木出母呷子经抢救无效死亡。

四、调查访问情况：

经询问报案人李世明（男，58岁，身份证号：，户籍地：北京市海淀区南太平路40号2楼2单元103号，工作单位及职务：中铁建设集团有限公司项目部综合室主任，联系方式：13341026130），其称：2012年5月27日9时许，他在家中休息，接到单位电话，称：“在工地有人打架，已经拨打了999”。后他拨打派出所电话报警。

经询问木洛尔地木（女，18岁，身份证号：，户籍地：中国四川省越西县依洛地坝乡依洛村火花组4号，现住地：北京市昌平区小汤山镇土沟村国家电网办公科研综合楼工地生活区东2-1-08宿舍，工单位及职务：昌平区小汤山镇土沟村国家电网办公科研综合楼工地架子工，联系电话：13164289992），她称：2012年5月27日7时许，她起床后发现木出母呷子与同宿舍的老乡躺在木出母呷子的床上喝白酒。8时30分许，木出母呷子不喝了，准备出去。但那名老乡还躺在木出母呷子的床上。木出母呷子让那名老乡起来。但那名老乡不起来。木出母呷子说：“你要是不起来，信不信我给你一巴掌”。那名老乡说：“我不信”，并一边说一边起身从自己床下拿起一个啤酒瓶走到木出母呷子面前。木出母呷子将该老乡推倒。在该老乡倒地的过程中，啤酒瓶摔碎，但没撒手。木出母呷子说：“你看，我推你一下你就倒了，你还想跟我打。”说完，木出母呷子准备将该老乡从地上扶起来。在木出母呷子弯腰时，该老乡手持碎啤酒瓶扎了木出母呷子左胸一下。木出母呷子胸部出血，说：“你还真扎我。”后木出母呷子倒地。后木出母呷子被送至医院，经抢救无效死亡。

经木洛尔地木辨认，木出支古日（男，49岁，身份证号：，户籍地：中国四川省越西县依洛地坝乡沙木洛村光明组76号）就是持碎酒瓶将木出母呷子扎伤的那名老乡。

经询问木出苏机子（男，别名：“阿边”，29岁，身份证号：，户籍地：中国四川省越西县依洛地坝乡依洛村红新组35号，现住地：北京市昌平区小汤山镇土沟村国家电网办公科研综合楼工地生活区东2-1-08宿舍，工作单位及职务：北京市昌平区小汤山镇土沟村国家电网办公科研综合楼工地架子工，联系方式：无），他称：2012年5月27日早晨，他被木出母呷子和木出支古日二人的吵架声吵醒。起床后发现木出母呷子和木出支古日还在吵架。后木出母呷子打了木出支古日一拳，两人打在一起。他上前拉开木出母呷子，发现木出母呷子左胸部有血。木出支古日右手拿一个碎啤酒瓶。后救护车赶到将木出母呷子送至医院。

经询问吉格阿西木（女，19岁，身份证号：，户籍地：中国四川省越西县尔赛乡申则洛村来福组51号，现住地：北京市昌平区小汤山镇土沟村国家电网办公科研综合楼工地生活区东2-1-08宿舍内，工作单位及职务：北京市昌平区小汤山镇土沟村国家电网办公科研综合楼工地架子工，联系电话：无），她称：2012年 5月27日7时左右，木出母呷子在床上睡觉。她隐约听到同宿舍的老乡起床后向木出母呷子要钱买水，木出母呷子好像给了该老乡1.5元。过一会儿，该老乡又到木出母呷子的床上对木出母呷子说：“借我10块钱，我去买酒喝。”木出母呷子让她给了该老乡10块钱。约2分钟后该老乡买了一瓶白酒回来，给木出母呷子倒了一杯白酒。木出母呷子一口喝了白酒后要睡觉。该老乡又倒了一杯白酒让木出母呷子喝。他起来后说：“别让他喝了，他一会还出去，我替他喝。”他一口将白酒喝了后就睡着了。后她被木洛尔地木叫醒，醒后看见木出母呷子胸前流血。后木出母呷子被急救车送至医院，经抢救无效死亡。

经吉格阿西木辨认，木出支古日（男，49岁，身份证号：，户籍地：中国四川省越西县依洛地坝乡沙木洛村光明组76号）就是向木出母呷子要钱买水买酒的那名老乡。

经询问龙利强（男，28岁，身份证号：，户籍地：中国四川省南充市仪陇县日兴镇新建接358号，现住地：北京市昌平区小汤山镇未来科技城国网智能电网研究院工程工地生活区，工作单位及职务：北京市昌平区小汤山镇土沟村国家电网办公科研综合楼工地架子工组长，联系方式：18601263301），他称：2012年5月27日5时许，他到木出母呷子宿舍叫架子工去工地上班。该宿舍有6名架子工。但只有一名架子工起床与他到工地上班，其余5名架子工都没有起床。8时30分许，木洛尔地木到工地找他说木出母呷子被同宿舍的老头扎死了。后他赶回生活区，看见“阿边”抱着木出母呷子坐在生活区南侧路上。木出母呷子脸色发白，左胸口有血，神志不清，也无法说话。他到了木出母呷子宿舍，发现木出支古日睁着眼躺在床上。宿舍地上有碎了的啤酒瓶。他问木出支古日是怎么回事？木出支古日不说话。后急救车赶到将木出母呷子送至医院，木出母呷子经抢救无效死亡。

五、破案经过：

2012年5月27日11时30分许，小汤山派出所民警在北京市昌平区小汤山镇土沟村国家电网办公科研综合楼工地生活区东2-1-08宿舍内将犯罪嫌疑人木出支古日抓获。并将木出支古日带至小汤山派出所约束至酒醒。2012年5月27日13时，木出支古日酒醒后，依法被刑事传唤至昌平刑侦支队进行审查。

2012年5月27日，犯罪嫌疑人木出支古日因涉嫌故意伤害被昌平公安分局依法刑事拘留。木出母呷子被故意伤害案成功告破。
