一、接报案件情况

2012年4月27日16时10分，昌平分局十三陵派出所接刘长东报警称：在北京市昌平区十三陵镇德陵广场一个女的被打死，嫌疑人是刘长贵。我队于2012年4月27日16时40分许接此情况后，立即组织警力赶赴现场开展工作。

二、现场及法医检验情况

案发现场两处，一处位于北京市昌平区长陵镇德陵村广场，另一处位于北京市昌平区长陵镇德陵村104号北平房东边卧室内。

长陵镇德陵村广场死者为女性，头部钝器伤。

长陵镇德陵村104号北平房东卧室床上一名男性死者，头部钝器伤。

经法医检验，死亡原因为颅脑损伤死亡。

三、死者基本情况

1、死者马丽荣，女，54岁，户籍所在地：北京市昌平区长陵镇德陵村143号，身份证号码：。

2、死者刘长增，男，57岁，户籍所在地：北京市昌平区长陵镇德陵村104号，身份证号码：。

四、调查访问情况

1、据报案人刘长东（男，43岁，户籍所在地：北京市昌平区长陵镇德陵村16号，现住址：同户籍地，身份证号码：，联系电话：13701386399，现为德陵村村委主任）讲：2012年4月27日16时许，他正在村委办公室，这时村民王凤云跑到村委会称：“出大事了，打死人了。”他和王凤云等人跑到广场看到马丽荣（女，54岁）躺在地上头部全是血。看到此情况，他立即报警。他在现场询问村民谁干的，这时村民刘长海（男，70岁左右，德陵村人）称是刘长贵干的。约五、六分钟，其看到刘长贵拿着一把锄头从北上坡下来，他上前将锄头夺下并与村民将刘长贵控制。

2、据目击者吴绪清（女，58岁，户籍所在地：北京市昌平区长陵镇德陵村78号，现住址：同户籍地，身份证号码：，联系电话：15801519314）讲：2012年4月27日16时许，她正在德陵村广场待着。她听到有人吵架，随后她看到马丽荣抱着孙子在前面走，刘长贵手拿锄头跟在身后，一边走一边骂。马丽荣说你想怎么样，两人此时站住。她走到两人身边说“五牛子（刘长贵），你别嚷了，吓到孩子了”。话还没说完，刘长贵便举起锄头砸在马丽荣右侧额头上，嘴里喊“我他妈弄死你”。当时马丽荣头部出血，喷在孩子脸上，她上前赶忙将孩子夺下跑开。她回头看到马丽荣被打后还站着。刘长贵又举起锄头打在马丽荣头上，将马丽荣打倒在地，并用锄头击打倒在地上的马丽荣头部十余下，又用锄头击打马丽荣肚子四五下。后刘长贵拿着锄头向北上坡处走。此时，她看到孩子左侧额头处鼓起一个坑，破了在流血。过了约十分钟左右，刘长贵拿着锄头从北坡下来，被村干部按倒，后来听村民说刘长贵上北坡将他二哥刘长增打死了。

3、据死者马丽荣的丈夫刘长华（男，54岁，户籍所在地：北京市昌平区长陵镇德陵村143号，现住址：同户籍地，身份证号码：，联系电话：13716613342）讲：刘长贵是其五弟。父母在世时有个小院，三间房。他们兄弟五人都有自己的宅基地。父母通过公证处将三间房及小院给了三个女儿。五弟刘长贵觉得自己最小应该把房子给他。因为此事，刘长贵酒后经常与兄弟姐妹闹。

他家中大哥刘长荣、老二刘长增、老三刘长华、老四刘长富、老五刘长贵，三姐妹刘秀荣、刘秀金、刘秀兰。

五、抓获犯罪嫌疑人及供述情况

2012年4月27日16时30分许，民警在德陵村村委会的协助下在北京市昌平区长陵镇德陵村广场将犯罪嫌疑人刘长贵抓获。

犯罪嫌疑人刘长贵，男，48岁，户籍所在地：北京市昌平区长陵镇德陵村156号，现住址同户籍地，身份证号码：。

经讯问，犯罪嫌疑人刘长贵供述：他因为父母房产分配问题对兄弟姐妹不满。2012年4月27日16时许，他从家中携带锄头前往马丽荣家。他在广场看到马丽荣，对马丽荣进行辱骂。并用随身携带的锄头击打马丽荣头部，将马丽荣打倒后继续持锄头击打马丽荣头部。见马丽荣不动后，他携带锄头来到二哥刘长增家，用锄头将刘长增打死。他来到德陵村广场被村干部拦住，后被警察抓获。刘长贵对持锄头将三嫂马丽荣、二哥刘长增打死的犯罪事实供认不讳。

现刘长贵因涉嫌故意杀人罪已被昌平公安分局刑事拘留，此案件正在进一步工作中。

1. She turned her head and saw Ma Lirong was still standing after being beaten. Liu Changgui raised his hoe and hit Ma Lirong on the head again, knocking Ma Lirong to the ground. He hit Ma Lirong's head more than ten times with the hoe, and hit Ma Lirong's stomach four or five times with the hoe. Later, Liu Changgui walked uphill to the north with a hoe. At this time, she saw a crater on the child's left forehead, which was broken and bleeding. About ten minutes later, Liu Changgui came down from the north slope with a hoe and was pushed down by the village officials. Later, the villagers said that Liu Changgui went up to the north slope and beat his second brother Liu Changzeng to death.

V. Arrest of criminal suspects and their confessions

After interrogation, the criminal suspect Liu Changgui confessed that he was dissatisfied with his brothers and sisters because of the distribution of his parents' real estate. At around 16:00 on April 27, 2012, he carried a hoe from his home to Ma Lirong's home. He saw Ma Lirong in the square and insulted Ma Lirong. And hit Ma Lirong on the head with the hoe he carried with him, and after knocking down Ma Lirong, he continued to hit Ma Lirong on the head with the hoe. Seeing that Ma Lirong was not moving, he brought a hoe to the home of his second brother Liu Changzeng and beat Liu Changzeng to death with the hoe. When he came to the square of Deling Village, he was stopped by the village cadres, and was later arrested by the police. Liu Changgui confessed to the crime of beating to death his third sister-in-law Ma Lirong and second brother Liu Changzeng with a hoe.

Now Liu Changgui has been criminally detained by the Changping Public Security Bureau on suspicion of intentional homicide, and the case is under further work.
