为深入贯彻落实中央政法委、省委政法委继续深入化解涉法涉诉进京访案件的部署要求,按照公安部关于开展重点信访案件专项治理活动的总体安排,根据《全市公安机关开展重点信访案件专项治理工作方案》,结合我县公安机关重点信访案件情况,我局决定从201112月至明年党的十八大召开前,在全县公安机关组织开展重点信访案件专项治理活动,并制定如下工作方案:

一、指导思想和目标任务

以解决群众合理诉求、促进社会公平正义、构建和谐警民关系和维护正常信访秩序为指导,以化解中政委和部、厅、市局交办案件和今年以来未化解赴省进京信访案件为重点,以案结事了、停访息诉、人不回流为标准,坚持把摸排和解决问题贯穿专项治理始终,确保实现“明年全国‘两会’前所有交办案件息诉80%,六月底前基本实现停访息诉、案结事了,所有信访积案基本得到消化解决,赴省、进京访势头得到有效遏制,公安信访形势进一步好转”的目标要求,为党的十八大胜利召开创造和谐稳定的政治环境。

一是集中解决一批重点信访案件。重点解决中政委、公安部、省厅交办的58起和市局排查交办的信访案件,2012年全国“两会”前化解60%以上,20126月底前基本实现停访息诉、案结事了。

二是自行排查化解一批信访问题。在上级交办重点信访案件的基础上,各派出所及各警种也要自行排查化解清积活动中尚未息诉的公安信访问题以及2010年以来新发生的信访问题。

三是进一步推进信访工作机制创新。认真研究公安信访的规律和特点,进一步创新完善信访问题源头预防、信访事项终结退出、信访事项交办督办、信访工作质量评价、信访工作区域警务合作等工作机制,增强基层公安机关及时、就地解决信访问题的能力和水平,切实引导信访工作重心下移。

二、组织领导和任务分解

(一)组织领导

    县局成立全县公安机关重点信访案件专项治理领导小组,局党委书记、局长刘德松任组长;局党委其他成员任副组长;相关单位负责人为成员。领导小组下设专项治理办公室,由局党委副书记李扬兼任办公室主任,法制室主任周辉任副主任。

局属各执法单位同时成立相应组织。

(二)任务分解

 专治办:整合信访攻坚办、评查办力量,成立全县公安机关重点信访案件专项治理办公室,负责专治活动的策划、协调,化解工作情况的审查、上报,成绩的宣传、报道和总结、考核、评比工作。

法制部门:督查、考评案件评查、过错究责工作;评查本局本单位管辖的案件,提出过错究责意见;督导无理访申报终结工作;审查部门警种和下级公安机关提请终结的案件,申报经审查符合终结条件的案件;组织提交局务会会诊重大、复杂、疑难信访案件;为处置非访活动、治理非访问题和教育处罚违法上访人员提供法律指导。

督导案件化解、问题整改、机制完善;审查化解工作质量,审核上报工作文件。

纪检监察部门:监督落实案件评查意见;倒查追究和督导下级公安机关倒查追究有责领导、单位和民警的信访过错责任。

部门警种:负责治理本部门本警种管辖的案件,梳理整改本部门本警种存在的问题,创新完善部门警种信访工作机制;督导下级公安机关部门警种案件化解、问题梳理、整改提高和机制创新工作。

督察部门:督察各地各部门专项治理情况和民警履职尽责情况。

三、时间安排和工作步骤

总体安排是:从201112月至党的十八大召开前,分阶段、有重点地扎实开展。大致分为动员部署集中治理深入推进收尾验收4个阶段。201112月上旬,作为第一阶段,以动员部署、排查梳理为主;201112月中旬至2012年全国“两会”,作为第二阶段,集中治理信访问题,配合做好全国、省、市、县“两会”信访安保工作;2012年全国“两会”后至20106月底,作为第三阶段,全面深化,重点突破;20127月至党的十八大召开前,作为第四阶段,检查验收化解成效,巩固强化化解成果,同时围绕党的十八大胜利召开做好信访维稳工作。

(一)动员摸排阶段(201112月上旬)

1、动员部署。层层发动部署,逐级确定工作专班,抓紧制定实施方案,在较短的时间内落实领导包案和部门警种责任,确保各项要求落到实处。信访量多的部门警种,也要结合本部门本系统实际,制定实施方案,细化工作措施。

2、排查梳理。信访攻坚战役中尚未化解的“钉子案”、“骨头案”,要作为工作重点。其中,已有结论的历史遗留问题、尚在法律程序中的、依法终结的、已签订停访息诉协议又没有新的事实理由的,以及反映违法闹访被公安机关依法处理的信访案件,不纳入专项治理范围。

(二)集中治理阶段(201112月中旬至2012年全国“两会”结束)

1、集中化解。各地要在排查疏理的同时,积极开展案件化解工作,以中政委、公安部、省厅和市局交办案件为重点,区别不同情况,逐案制定方案,分类进行化解,掀起化解工作高潮,力争将大部分案件化解在这一阶段。要结合“两节”、“两会”和“大走访”开门评警活动,适时开展开门接访、带案下访、登门“送温暖”等活动,拉近与信访群众距离,推动、扩大化解效果。通过超常动作,采取超常措施,集中突破一批重点信访案件,确保2012年全国“两会”前化解60%的工作目标。

2、集中录入。要对中政委、公安部和省厅交办的重点信访案件,以及本级排查梳理出的信访事项,全部录入公安信访信息管理系统二期。系统中已有记录的,要逐案补充、细化情况,尤其是案件的办理情况录入要详实,息访保证书、司法鉴定、终结结论、移交管辖证明以及相关法律文书等必须一并扫描录入,以便公安部认定核销。不纳入专项治理范围的5类案件,也要将有关情况录入系统,切实掌握底数。

(三)深入推进阶段(2012年全国“两会”后至20126月底)

2012年全国“两会”后,要及时对剩余案件进行梳理,并对面上形势进行评估,按照“面上促、重点督”的原则,找准重点地区、重点警种、重点案件,蹲点督导,重点突破;抓住重点疑难案件特别是“骨头案”、“钉子案”集中进行攻坚,以此带动整个化解工作。20126月底前,所有交办重点信访案件要基本实现停访息诉、案结事了。

(四)收尾验收阶段(20127月至党的十八大召开前)

各单位要回顾、总结集中化解工作情况,对已息诉案件开展走访、回访,巩固化解成效;对重点信访人员落实稳控措施,防止发生极端事件;总结、推广成功案例、典型经验和先进事迹,及时健全完善信访工作机制。局督导组将对专项治理情况和成效进行检查验收。

四、工作措施和总体要求

(一)强化组织,落实责任

一是狠抓部署推动。各单位要召开专题会议,对重点信访案件化解工作进行动员、部署、安排。切实把思想行动统一到公安部部署要求上来,把专项治理工作纳入“三项重点工作”和“三项建设”的总体部署,坚决克服畏难思想和厌战情绪,切实增强责任感和紧迫感,以最大的决心、最强的力度、最实的措施,强力推进重点信访案件治理活动的开展。

二是狠抓责任落实。主要领导要担负起率先垂范带头作用,包案领导进一步加强包保责任,对中政委和部、厅、市局交办的案件,按照“五定”(定领导、定方案、定专人、定质量、定时限)、“五包”(包掌握情况、包解决困难、包教育转化、包稳控管理、包依法处理)的工作要求,形成“一起案件、一名领导、一套班子、一个方案、一抓到底”的工作格局,逐级压实包案责任,确保达到预期目标。化解的案件要逐案建档报局专治办,同时与县局信访工作领导小组签订进京上访案化解目标责任书,明确责任,限期化解。活动开始后,县局将在主页开设专栏公开县局领导包案情况,并定期对化解情况通报、排名。县局将定期对治理情况予以通报。

三是狠抓督导检查。局实行局领导包片负责制,局领导深入分片包干乡镇带案督办重点上访案件,共同研究化解攻坚措施,集中攻坚;市、县局督导组在巡回督导的同时,划定二至三个交办案件多的重点治理地区和单位,实行重点督办、跟踪问效;同时强化部门警种主体责任和化解能力,加强部门警种间协作联动,对疑难信访案件成立由相关部门人员参加的化解工作组,破解信访坚冰。

(二)分类甄别,高效治访

局将把重点信访案件专项治理作为一项硬任务,要动员全社会和全局的力量,依靠党委和政府的领导,组织多部门尤其是政法机关共同参与,各部门警种整体联动,协调配合,运用政策、法律、经济多种手段,合力治访。

一是对依法律、按政策、论情理不应解决的问题,下决心逐级报请有权机关批准终结。有些信访问题已多次办理,事实清楚,定性准确,过错责任查究到位,解释疏导教育到位,实际困难帮扶到位,信访人仍坚持无理诉求继续四处上访,对此类符合终结条件的信访积案,要坚决按照严格、审慎原则,下决心、依法律、按程序报请有权机关批准终结。批准终结的案件,要及时按照部门办事项、地方包稳控的工作要求,将对信访人的稳控工作责任提请当地党委政府移交基层组织落实稳控工作责任。终结后仍坚持非正常信访的,要积极配合有关单位做好教育、稳控工作,违法闹访扰乱社会秩序的,依法严肃处理,及时畅通信访出口。

二是对单靠公安一家难以解决的问题,要积极争取党委、政府支持,加强与地方涉访各部门联动。信访问题涉及的领域不断扩大,触及的层面不断加深,有的还相互交织在一起,如征地拆迁安置、非法集资等引发的信访,原因复杂,涉及面广,政策性强,处理难度大,仅靠公安力量难以解决,要积极主动向当地党委、政府汇报,由信访局、信访联席办牵头,公安作为主力军配合办理;对涉及案件定性、法律适用的复杂信访问题,要及时向政法委汇报,由政法委牵头,各政法部门通力合作,共同化解。

三是对不易解决的问题,要形成各部门警种综合治访的工作机制。要改变信访工作只是靠信访部门苦苦支撑的局面,各部门警种对本部门、本警种信访案件办理情况切实担负责任,局将努力推动抓源头、抓督办、抓倒查、抓追究,统筹兼顾,整体推进,推动各项信访工作措施落实,形成信访部门协调,法制部门把关,纪委、督察监督,政工部门教育,各警种联动、部门配合,各负其责、齐抓共管综合治访的工作新格局。坚持当事人不息诉、化解工作不停止的愚公移山精神,用硬措施啃下“骨头案”,用钉子精神化解“钉子案”。 对多次上访、多次处理仍未息诉的来省进京访案件,调整办案人员和办案思路,重新组织专班进行核查,逐案分析,逐案制定化解方案,必要时,经局党委研究,可上提一级,由上级领导包案处理;对已丧失破案条件、调查后没有问题或经多次复查已有结论案件,要明确告知信访人调查结论和公安机关所做工作;仍不服的,及时开展公开听证、帮扶救助和疏导教育;对犯罪嫌疑人在逃、涉案财物管理、非正常死亡类案件,要及时纳入有关专项行动,借力化解。

(三)严肃评查,刚性纠责

对上级交办的案件,要从程序上和实体上进行全面评查,对事实认定、证据收集、程序应用、法律适用等方面的情况进行客观评价,找出问题症结,发现有执法瑕疵的,及时纠正;执法过错的,要严格落实执法责任制和错案追究制,对故意或者过失造成认定事实或适用法律错误的案件,或者违反法定程序办理的案件,坚持实事求是、有错必纠的原则,严格依照执法责任制,追究有关人员责任,真正做到有质量问题就要有过错分析、有过错问题就要有人承担责任。

(四)定期通报,全面考评

把专项治理工作的情况和实效纳入公安信访工作绩效考评,对专项治理工作进展情况 “一月一通报、一周一排名”。从201112月起,每月底前,各单位要将专项治理工作进度情况报送县局专项治理办公室。各单位要及时总结典型经验,研究分析工作中存在的困难和问题。

专项治理活动中,对因行动迟缓、工作不力被通报批评的或因重视程度不够、问题解决不力未能按时完成息诉任务的,由单位主要负责人向局党委说明情况;同时,对于工作不力引发新的被公安部及省厅督办信访事项的部门和警种,凡造成一定后果的,对部门警种负责人一律实行约谈,取消年内评先评优资格。

(五)标本兼治,堵源截流。要坚持一手抓处理信访突出问题,清理旧账,不欠新帐,最大限度地削减信访存量;一手抓初信初访和源头防范,完善执法监督、规范执法行为,落实日常矛盾纠纷排查化解制度,在基层公安机关和基础工作环节上下功夫,最大限度地压减信访增量,防止由初信初访转为重信重访,形成信访积案,不断完善信访长效机制,推动公安信访工作良性发展。

1. Guiding ideology and objectives and tasks


Guided by solving the reasonable demands of the masses, promoting social fairness and justice, building a harmonious relationship between the police and the public, and maintaining the normal order of letters and visits, the focus is on resolving cases assigned by the Central Political Committee, ministries, departments, and municipal bureaus and cases that have not been resolved this year to go to Beijing for letters and visits , based on the criteria of case closure, suspension of visits, suspension of complaints, and non-return of people, we insist on identifying and solving problems throughout the special governance, and ensure that "80% of all cases assigned before the National "Two Sessions" next year will be closed and lawsuits will be basically completed by the end of June. Realize the goal of stopping visits, suspending complaints, closing cases, basically digesting and solving all backlogged cases, effectively curbing the momentum of visiting provinces and Beijing, and further improving the situation of public security petitions, creating harmony for the successful holding of the 18th National Congress of the Communist Party of China stable political environment.


The first is to focus on solving a number of key petition cases. Focus on solving 58 petition cases assigned by the Central Political Committee, the Ministry of Public Security, and provincial departments, and investigations and assignments by the Municipal Bureau. 2. Organizational leadership and task breakdown


(1) Organizational leadership

Liu Desong, Secretary of the Party Committee and Director of the Bureau, served as the group leader; other members of the Party Committee of the bureau served as deputy group leaders; and the heads of relevant units were members. The law enforcement units under the Bureau set up corresponding organizations at the same time.


(2) Task decomposition


  Dedicated Office: Integrate the Office of Complaints and Visits, Evaluation and Investigation Office, and set up a special management office for key petition cases in the county's public security organs. It is responsible for the planning and coordination of dictatorship activities, the review and reporting of resolution work, the publicity, reporting and summary of achievements, Assessment and appraisal work.


Legal department: Supervise and evaluate case evaluation and fault accountability work; review cases under the jurisdiction of the bureau and unit, and put forward fault accountability opinions; supervise the termination of unreasonable visit declarations; review departmental police types and lower-level public security organs for termination of cases , declare the cases that meet the termination conditions after review; organize the submission of major, complex and difficult petition cases to the bureau affairs meeting; provide legal guidance for dealing with non-visit activities, governing non-visit problems, and educating and punishing illegal petitioners.


Supervise case resolution, problem rectification, and mechanism improvement; review the quality of resolution work, review and submit work documents.


Disciplinary inspection and supervision departments: Supervise the implementation of case evaluation opinions; investigate and supervise the investigation and supervision of lower-level public security organs to investigate and investigate the responsibility of responsible leaders, units and civilian police for their faults in letters and visits.

3. Schedule and work steps


The overall arrangement is: From December 2011 to before the 18th National Congress of the Communist Party of China, it will be carried out in a phased and focused manner. It is roughly divided into four stages: mobilization and deployment, centralized management, in-depth promotion, and final acceptance. In the first ten days of December 2011, as the first stage, mobilization, deployment, and investigation and sorting were the main focus; from mid-December 2011 to the national "two sessions" in 2012, as the second stage, the issue of letters and visits was concentrated, and the national, provincial, and City and county "two sessions" petition security work; after the national "two sessions" in 2012 to the end of June 2010, as the third stage, comprehensively deepening and key breakthroughs; from July 2012 to before the 18th National Congress of the Communist Party of China, as the fourth stage, check and accept the results of resolution, consolidate and strengthen the results of resolution, and at the same time, do a good job in the work of letters, visits and stability maintenance around the victory of the 18th National Congress of the Communist Party of China.


(1) Mobilization stage (early December 2011)


1. Mobilization and deployment. Deployment is launched at all levels, special work classes are determined level by level, implementation plans are formulated promptly, and leadership package cases and departmental police responsibilities are implemented within a relatively short period of time to ensure that various requirements are implemented. 2. Check and sort out. The "nail cases" and "bone cases" that have not yet been resolved in the battle of letters and visits should be the focus of work. Among them, issues left over from history that have already been concluded, those that are still in legal procedures, those that have been terminated according to law, those that have signed a cease-and-desist agreement and have no new factual reasons, and petition cases that reflect illegal visits and have been handled by the public security organs according to law, Not included in the scope of special governance.


(2) Centralized governance stage (from mid-December 2011 to the end of the National "Two Sessions" in 2012)


1. Centralized resolution. All localities should actively carry out case resolution work while investigating and sorting out cases, focusing on cases assigned by the Central Political Committee, the Ministry of Public Security, provincial departments, and municipal bureaus, distinguishing between different situations, formulating plans on a case-by-case basis, and classifying and resolving cases, setting off a climax of the resolution work. Strive to resolve most cases at this stage. 2. Centralized entry. All the key petition cases assigned by the Central Political Committee, the Ministry of Public Security and the provincial department, as well as the petition matters sorted out at the same level, shall be entered into the second phase of the public security petition information management system. If there are already records in the system, it is necessary to supplement and refine the situation case by case, especially the case handling information must be entered in detail, and the interrogation guarantee letter, judicial appraisal, final conclusion, transfer of jurisdiction certificate, and relevant legal documents must be scanned and entered together. In order for the Ministry of Public Security to identify and cancel the verification. For the five types of cases that are not included in the scope of special governance, the relevant information must also be entered into the system to effectively grasp the bottom line.


(3) In-depth promotion stage (from the end of June 2012 to the end of June 2012 after the National "Two Sessions" in 2012)


After the National "Two Sessions" in 2012, it is necessary to sort out the remaining cases in a timely manner and evaluate the general situation. According to the principle of "superficial promotion and key supervision", identify key areas, key police types, and key cases, and supervise on a short-term basis. Before the end of June 2012, all the key petition cases assigned to handle should basically be stopped, sued and closed.


(4) Final acceptance stage (from July 2012 to before the 18th National Congress of the Communist Party of China)


All units should review and summarize the situation of centralized resolution work, conduct visits and return visits to cases that have been dismissed, and consolidate the results of resolution; implement stabilization and control measures for key petitioners to prevent extreme incidents; summarize and promote successful cases, typical experiences and advanced deeds , Improving and perfecting the working mechanism of letters and visits in a timely manner. The bureau supervision team will inspect and accept the special governance situation and effectiveness.


4. Work measures and general requirements


(1) Strengthen the organization and implement responsibilities


The first is to pay close attention to deployment promotion. All units shall hold special meetings to mobilize, deploy and arrange the resolution of key petition cases. Effectively unify thoughts and actions with the deployment requirements of the Ministry of Public Security, incorporate special governance work into the overall deployment of the "three key tasks" and "three constructions", resolutely overcome the fear of difficulties and war-weary emotions, and effectively enhance the sense of responsibility and urgency. The second is to pay close attention to the implementation of responsibilities. The main leaders should take the lead in setting an example, and the leaders of the case should further strengthen the responsibility of guaranteeing the case. After the activity starts, the county bureau will set up a column on the homepage to disclose the case situation of the leaders of the county bureau, and regularly report and rank the resolution situation. The county bureau will regularly report on the governance situation.


The third is to pay close attention to supervision and inspection. The bureau implements the responsibility system of the bureau leaders. The bureau leaders go deep into the sub-districts and townships to supervise the handling of key petition cases, jointly study the measures to resolve the tough problems, and concentrate on tackling the tough problems; the city and county bureau supervision teams designate two to three For key governance areas and units assigned to handle many cases, implement key supervision, follow-up and follow-up; at the same time, strengthen the main responsibility and resolution capabilities of departmental police departments, strengthen cooperation and linkage between departmental police departments, and establish resolution work for difficult petition cases involving personnel from relevant departments Group, crack the ice of letters and visits.


(2) Classification and screening, efficient treatment and interview


The bureau will take the special treatment of key petition cases as a hard task. It must mobilize the power of the whole society and the overall situation, rely on the leadership of the party committee and the government, organize multiple departments, especially the political and legal agencies to participate, and all departments and police departments will cooperate and coordinate as a whole. Use policy, law, and economic methods to work together to control visits.
